In New York State, those injured at work may not recover for their pain and suffering unless they can prove that their injuries are the fault of someone other than their employer or a co-employee. Those entities are protected by the Workers’ Compensation Law and they cannot be sued for negligence resulting in personal injury. However, if an accident is caused by the negligence of someone else, not your employer or co-employee, you may have a viable legal claim to recover damages.
- Social Security Disability
If you have a disability that prevents you from working you may qualify for benefits from the Social Security Administration. First, you must have insured status in order to qualify for benefits. Under social security rules, you become insured when you have worked for a minimum period of time in a “covered employment.” If you meet the requirements and are insured, you must demonstrate that you have an impairment that prevents you from performing substantial gainful employment.
- Workers’ Compensation
The purpose of the Workers Compensation system is to provide limited benefits to those injured at work regardless of whether or not their employer was at fault for their injury. In order to understand whether you’re entitled to benefits under workers’ compensation laws, you first should understand some basics about the purposes of workers’ compensation systems. Workers’ compensation begins with insurance. This insurance provides cash benefits and/or medical care for employees who are injured or become ill as a direct result of their job.
- Work Related Hip Replacement
Work related hip injuries can be caused by a traumatic event or repetitive activities. Many such injuries or conditions ultimately require total hip replacement surgery. Total hip replacement is an extensive procedure usually resulting in many months lost time for recovery. Additionally, a significant mobility deficit almost always results. If you have sustained a hip injury and have undergone total hip replacement surgery, you should have a complete understanding of your legal rights under the New York State Workers’ Compensation Law.
- Permanent Facial Scars and Disfigurements
Workers’ Compensation Law Section 15 allows for a monetary award for a permanent facial scar or disfigurement above the neck or extending partially onto the neck area. A medical report indicating that the scar is permanent must be produced before the case is ready for a formal award. It is not uncommon that facial disfigurement awards are appealed so that the adequacy of the award may be reviewed.
