- Divorce

- Child Custody
One of the most difficult issues in the divorce process is custody of the children. There are two different aspects of a custody determination: Legal custody and Parenting schedule. Legal custody determines which parent makes the decisions affecting the well being of the children and the parenting schedule dictates the time the children will spend with each parent. At Pesch Law Office, we understand that your family is changing, not ending. We will strive to make this transition as smooth as possible.
- Child Support
Under Illinois law, both parents have the legal obligation to support their children. If the children reside with you, your support will take the form of daily food, clothing and shelter. If you are the non-residential parent, you will be obligated to pay a certain percentage of your net income to the other parent as contribution to the daily expenses of raising your children.
- College Expenses
Children whose parents are divorced are entitled to contribution to college expenses from both of their parents. The law provides that the Court may award a sum of money as contribution from the property and income of either or both parents for the college education, professional or other training after high school. 750 ILCS 5/513(a)(2). After considering the resources or ability to pay of the parents and the child, college expenses are allocated.
- Mediation
As an alternative to litigating each and every issue that is raised in your divorce case, you and your spouse can participate in mediation in an attempt to reach a complete agreement. Mediation is conducted over a series of appointments between the parties and a trained mediator. The role of a mediator is to facilitate an agreement. The mediator will listen to the parties’ opinions and highlight any common ground between the two and rephrase the issues to present an understandable agreement.
- Collaborative Law
Collaborative law is a way of practicing law whereby the attorneys for both of the parties in a family dispute agree to assist them in resolving conflict using cooperative strategies rather than adversarial techniques and litigation. Early non-adversarial participation by the attorneys allows them to use attributes of good lawyering not greatly utilized in the usual adversarial proceedings, namely use of analysis and reasoning to solve problems, generation of options, and creation of a positive context for settlement.
