Practice Areas Description
- Elder LawRelatively few attorneys know the field of elder law as well as our Brooklyn, New York law firm of Polizzotto and Polizzotto, LLC does. Our elder law practice was started by our founder, Alfred Polizzotto, more than 15 years ago. Over time, our lawyers have expanded in knowledge and accumulated relevant experience in this area. Elder law is a very broad area of law. It encompasses issues such as: rights of the elderly, trusts and estates, Medicaid guardianship, durable powers of attorney, conservatorships, health care proxies, mental hygiene laws, nursing home benefits, nursing home negligence and appointment of trustees.
- Medicaid Planning / Asset Protection
In 2006, a new law was enacted affecting your ability to qualify for nursing home care and Medicaid. This new law is called the Deficit Reduction Act of 2005 (“DRA”). The DRA includes changes to qualifying for nursing home care under Medicaid. These changes require earlier and better Medicaid planning, including better record keeping. You want to pass as much of your estate as possible to your children and spouse. We can help you preserve much of your estate and properly plan to qualify for Medicaid assistance when the time comes. However, it is essential you plan ahead. Contact our Staten Island or Brooklyn New York Medicaid planning attorney for a confidential consultation and advice on how to properly plan for old age, sickness, or disability.

As neighborhood estate planning and estate administration lawyers, we are trusted by our clients for our extensive knowledge of probate law, including the preparation and administration of final testamentary instruments such as wills and trusts. Even more importantly, our Brooklyn estate planning attorneys know how to help plan the financial aspects of your estate to maximize the inheritance you will leave behind for your loved ones or charitable beneficiaries. We can help you plan, prepare and administer: income only trusts, living trusts, charitable trusts and guardianships.
- Wills
A will is important for adults of all ages. It allows you to choose the beneficiaries for your assets and express important decisions regarding your estate in the event of your death. Most importantly, however, having a will can protect your family from disputes and litigation over your children; when sentimental family heirlooms are identified and given to specific beneficiaries, the potential for arguments is greatly reduced. A living will is another important consideration. This document expresses your wishes regarding health care procedures, should you become incapacitated.
- Trusts
There are two main types of trusts — revocable trusts and irrevocable trusts. Revocable trusts may be used in place of a will when there is an unequal distribution of assets among family members. With these trusts, your family can avoid probate. Irrevocable trusts transfer assets and money to a family member for the purpose of Medicare and Medicaid planning. They can also be used for tax planning. We can also help you set up the following: AB trusts / credit shelter trusts, special needs trusts, 253 trusts, income only trusts, charitable trusts and qualified personal residence trusts.

The attorneys are experienced and knowledgeable in all aspects of estate administration, including probate. We have the capability to help you successfully distribute your loved one's assets according to his or her wishes, and challenge those wishes under qualified circumstances. Probate is the process of distributing property and assets according to the terms of a will. While this process is often a simple matter when there is a valid will, disputes can arise among beneficiaries and other relatives.
