Prescott & Pearson P.A. is a Minnesota bankruptcy law firm representing clients for more than 35 years. In 1951, attorney Jack Prescott filed his first bankruptcy petition on behalf of a client. In 1975, seeing the growing need that Minnesota families and small businesses had for better legal service in this area, Jack Prescott made the decision to concentrate his practice solely on bankruptcy. In 1981, Dick Pearson began practicing in bankruptcy law and joined the firm in 1983. Today, over 70,000 successful bankruptcy petitions later — we remain just as committed to this work.
Bankruptcy is governed by federal laws that make the general rules and process relatively the same from one state to the next. Because of that, many "national bankruptcy law firms" have started looking for business everywhere, including Minnesota. While these firms may be able to learn our state's specific rules without too much trouble — they will never be able to match our local knowledge, or the credibility we've established with the bankruptcy judges, trustees and creditors' attorneys.
One of our biggest sources of new business has always been other law firms. Our bankruptcy practice includes:- Chapter 7 Bankruptcy
Filing for Chapter 7 bankruptcy protection can also put an immediate stop to creditor harassment and wage garnishments — and put at least a temporary stop to home foreclosure proceedings or car repossession (but you usually need to become current on your payments if you want to keep these assets in a Chapter 7).
- Chapter 13 Bankruptcy
There are many reasons why you might want to file for bankruptcy protection under Chapter 13 instead of Chapter 7. Here a few of the most common: You don't feel right about not paying your unsecured creditors back something; You have too much nondischargeable debt, too much income or too many assets to file a Chapter 7 bankruptcy; You want to keep your home but need time to make up the payments you've already missed; You owe more money on your home than it's worth (usually due to second mortgages or home equity lines of credit); You want to keep your car; You owe taxes that a Chapter 7 bankruptcy won't get rid of and you need time to pay the IRS back; You have assets such as a second home that would most likely have to be liquidated in a Chapter 7 bankruptcy.
