Divorce is a complex process, both emotionally and legally. It involves issues relating to your children, their residence and timesharing with each parent, issues relating to the identification, valuation and ultimate distribution of your property, alimony and child support. It is a process that can and often does affect every aspect of your life. We are here to assist you with this process.
- Child Custody
During a divorce, if you and your spouse have minor children, you will be faced with making difficult decisions regarding your future responsibilities toward your children, where your children are to reside and how decisions affecting your children’s future will be made. We have assisted countless parents in these all-important matters.
- Alimony
Alimony, also referred to as spousal support or maintenance, is generally defined as payments from one spouse to the other on a temporary or permanent basis. The purpose of Alimony generally is to enable a spouse to continue to live in a lifestyle or standard of living similar to what was enjoyed during the marriage. Here are the several types of Alimony: Temporary Alimony; Permanent Alimony; Rehabilitative Alimony; Bridge-the-Gap Alimony (or Transitional alimony).
- Child Support
In a divorce proceeding, the Court may, at any time, order a parent who owes a duty to support his or her children to pay child support in accordance with the Florida Child Support Guidelines. Child support is calculated based on the income of the Parties. Furthermore, if the Parties have daycare, afterschool care and health insurance payments, those items are calculated in the child support guidelines. Our attorneys are well-versed in the mathematics of child support calculation, from the beginning point of determining true monthly income through the process to determine the final and correct figure.
- Marital Assets & Debts
During dissolution of marriage, in the event that the parties are unable to agree to a division of their property, the court will determine and divide their property based on a concept of an equitable distribution. First the court determines if there are any non-marital assets. Second, the court will determine the marital assets and liabilities. The Court then is faced with the valuation of marital assets and ultimate distribution of those assets and liabilities unless there is a justification for an unequal visitation based on the factors enumerated under the statute.
- Visitation
Making child visitation arrangements work for the parents and focus on the needs of the children is always a challenge, and one we have extensive experience handling.
- Modification
A court order that initially works well may not continue to serve your needs or the needs of the children without adjustment. We handle all types of divorce modifications.
- Paternity
In Florida, the court will find out who the father is and then order him to provide the most support possible for the child. Legal representation in Florida paternity cases is critical.
