- DUI

Every case is unique and requires a New Jersey lawyer experienced in defending against DUI charges to maneuver through the New Jersey legal system. An experienced DUI attorney can make all the different in having your case completely dismissed or having your license taken away and possibly even your freedom.

- Boating DWI

All boating under the influence (BUI) charges are considered to be DUI charges under New Jersey law. The circumstances of operating a boat or water vessel are unique and subject to different factors than incidents that take place on land. Field sobriety tests, breath tests, and other investigative evidence are subject to influence from elements such as weather, sudden waves, etc. Because these conditions are so unique, it is often difficult for the state to make an effective legal argument against a suspected boater.

- Trucking DWI

Once a truck driver’s BAC level goes above 0.04%, they can be arrested for driving under the influence of alcohol. When a commercial vehicle driver is arrested for a DWI, he or she may be disqualified from driving a commercial vehicle for one year following their first DWI conviction. If the driver was transporting hazardous material when they receive their first DWI conviction, the minimum disqualification time period increases to 3 years. After a second DWI conviction, the driver will be disqualified from operating a commercial motor vehicle for life.

- Underage DWI

If you are under 21 years old and are convicted for driving or boating with a BAC of .01% or higher, the penalties include: License suspension for a 30 to 90 day period, select DWI fines depending on the situation, fifteen to thirty days of mandatory community service, participation in alcohol education and highway safety programs at an Intoxicated Driver Resource center. If you are unlicensed and under 17 years of age at the time of the incident, you are subject to a 30 to 90 day delay in processing your driver license.

- Multiple DWIs

At the Matthew Reisig Law Firm, our New Jersey DUI attorneys are experienced in dealing with individuals facing multiple DUI charges. A person with multiple convictions for driving under the influence of alcohol or drugs (DUI) has far more serious consequences than first-time offenders. In New Jersey, multiple offenders are often punished with heftier fines, longer jail sentences, and extensive license suspensions. In addition, you may also diminish your employment opportunities, experience higher insurance rates and possibly damage your reputation.

- DUID

Driving Under the Influence of Drugs (DUID) charges can be brought up against any person suspected of driving while under the influence of any hallucinogenic, narcotic, or other habit-producing drug. Drugs considered to affect the influence of driving include marijuana, cocaine, LSD, heroin, or other narcotics, including prescription or over the counter drugs. A DWI charge involving drugs is a serious matter with severe penalties. However, in the case of a DWI involving drugs, the state has a difficult case to prove. The sobriety and breathalyzer tests that show a person to be under the influence of alcohol do not show if a person is under the influence of drugs. Only a skilled New Jersey DUID attorney can help you prove your innocence.

- Military DUI

While driving on the roads of a military base, you are not subject to the state’s DUI laws, but instead required to follow the drunk driving laws of the federal government. If you are caught drunk driving, you will not only face serious penalties, but will also be required to go through the stressful process of a court-martial. While you can choose to accept the military officer assigned to your defense, you may find it is far more advantageous to hire a civilian New Jersey DUI lawyer to help you fight these charges.

- Commercial DWI

If you are convicted of driving under the influence, you can lose your commercial license for a full year. If you are driving a hazmat truck at the time, the suspension rises to three years. If you already have a DUI on your record, you may permanently lose your license. You will even be considered guilty if you refused to take a breathalyzer or blood test. If your BAC was above 0.08%, you will also face New Jersey state laws and may also face jail time. To save your job in these situations, you will need a New Jersey DUI attorney with experience fighting DUI charges against commercial truck drivers.

- Appeals

After your conviction, you only have 20 days to file an appeal to a higher court. These proceedings are held by a Superior Court judge. No new evidence is admitted in these trials. Your New Jersey DUI lawyer will instead work to show that you should not have been found guilty based on the evidence, or that the sentence is not in line with the actual criminal act committed. The judge cannot give you a stricter sentence than you have already received, so you have nothing to lose and everything to gain by filling an appeal.

- Driving with a Suspended License

When you are found guilty of driving on a suspended license, you will face very severe consequences. A first time offense will result in a fine of $500. Every case of driving on a suspended license is followed by a yearly $250 surcharge payable to the DMV. The surcharge will last three years–meaning a first time conviction will cost a total of $1,250. A second time offense will result in $750 in fines and up to 5 days in jail. The third offense can by punished by 10 days in jail and $1000 in fines. If any injuries were caused by a driver who was operating without a license, the jail sentence will be a minimum of 45 days long.
