Law Firm Overview

At the Rosen Law Firm, our entire practice is founded on the belief that you and your case, no matter how large or small, are important. And while that may seem like a simple and obvious premise, it is also one that we feel too many others easily forget. We have not. We have spent our lifetimes trying to do the best we can for families and individuals in the Charleston area and throughout the state of South Carolina.

Large law firms can offer and do many things for their clients. However, a smaller firm will provide individualized attention to each client and case. Attorneys Robert and Susan Rosen left the security of working in a large corporate firm to set up this law firm — a firm where they could take fewer cases, where they would have the time to give each case more time and attention, and where they could take a hands-on approach to working with clients.

Today, their skills as tough, experienced litigators combined with the knowledge and professional contacts they gained through working at a large law firm, consistently produce valuable benefits and results for their clients — benefits and results that come without the overhead costs that large firms typically have to cover.

Attorney Susan Rosen won a $7,000,000 verdict in Greenville County, one of the largest medical malpractice verdicts ever awarded in South Carolina. The verdict was later reduced to $3,500,000 due to a finding of the plaintiff's contributory negligence. Robert Rosen, a Fellow of the American Academy of Matrimonial Lawyers, is the author of six books, numerous articles, and a frequent lecturer on family law issues for legal education programs. Both Susan and Robert Rosen have been recognized in The Best Lawyers in America® reference guide and each has received an AV® Rating* under Martindale-Hubbell's peer-review rating system.

Practice Areas Description

- Personal Injury
At the Rosen Law Firm, we have spent our careers doing the best we can to help seriously injured people and grieving families recover compensation for losses caused by others. The legal knowledge and trial skills we have gained as a result can make a difference in your case too. However, early investigation and taking steps to preserve evidence are often critical keys to success.

- Wrongful Death
At the Rosen Law Firm, we represent families living throughout South Carolina who have lost loved ones due to the reckless, negligent, or wrongful actions of others. No matter the situation, we will always do our best to help families recover in a difficult time.

- Auto Accidents
The person legally responsible for an auto accident does not have to be someone driving 100mph or talking on their cell phone while doing today's crossword puzzle. The person at fault can be anyone who happens to make a simple, one-time mistake that may be devastating to the victim.

- Trucking Accidents
A complex web of local, state, and federal regulations governs the commercial trucking industry in the United States. There are rules about how trucks can be loaded, how cargo must be secured, where trucks can and cannot drive, how the vehicles must be maintained, how much they can carry, how long a driver can drive before they must stop to rest, and how much rest they have to take when they take it.

- Medical Malpractice
At the Rosen Law Firm, we know how tough it is to win medical malpractice cases in today's political climate, but that has done nothing to stop us from consistently achieving results anyway. However, because finding an expert physician who is willing to testify that a fellow doctor was negligent is a legal requirement for these cases, it is important to start investigating and building a strong case as soon as possible.

- Hospital Negligence
Any patient has the right to receive a reasonable standard of care at a hospital or other healthcare facility. What does reasonable mean? It means that the care you or a loved one receives at a facility should be similar to the type of care you would receive and expect from other professionals and institutions working in the same field under the same or similar conditions. South Carolina recognizes a national standard of care.

- Nursing Home Abuse and Negligence
Nursing home residents have a number of rights, including the right to be treated with respect and the right to receive a reasonable standard of medical care. What does reasonable mean? It means that the care you or a loved one receives at a facility should be similar to the type of care you would receive and expect from other professionals and institutions working in the same field under the same or similar conditions. Unfortunately, nursing home residents do not always receive this level of care — and many are outright abused.

- Birth Injuries
Doctors are human. There are situations that they have no control over and where even if they performed their jobs to perfection serious injury or death would still occur. This fact has some of its most tragic implications in the context of childbirth. But as we have said, doctors are human and sometimes their human shortcomings cause them to make mistakes - mistakes that can be devastating to their patients.

- Spinal Cord Injuries and Brain Injuries
Most people experience neck or back pain at some point in their lives. For the vast majority of us, the discomfort is only temporary and only a small taste of what people with serious spinal injuries suffer through nearly every minute of every day.
If you or someone you love has suffered a spinal cord injury because of another's negligent actions — do not be tempted by the prospect of a quick settlement. These injuries can require lifelong medical care and any compensation you receive should reflect that.

- Burn Injuries
If your body is burned in a fatal fire, the worst is over. Unfortunately, this is not true for burn injury victims who survive.
A third-degree burn injury is one of the most painful and traumatizing injuries a human being can suffer. Often, a burn victim who survives their initial brush with death must cope with what seems like an endless string of skin graft surgeries that only cause more pain as well as the emotional pain that comes with scarring, disfigurement, and psychological trauma.

- Defective Products
At the Rosen Law Firm, we have been representing the citizens of South Carolina in defective product cases for years and are not afraid to take on corporate and insurance company giants in the courtroom if they refuse to be reasonable and fair.

- Family Law and Divorce
At the Rosen Law Firm, we understand that family issues can be very upsetting and hard to deal with. Most family law attorneys do. However, we believe that what sets our firm apart is that we care enough about our clients to be honest with them and to tell them what they need to hear, rather than what they might want to hear about their case. We also believe that as experienced litigators, not afraid to take your case to court, we negotiate from a position of strength. This helps settle cases and helps save you money. We also take the time to help you understand the law, how the family court system works, and your full range of alternatives for solving the issues at-hand.

- Complex Property Division
At the Rosen Law Firm, we represent wives and husbands in the Charleston area and the surrounding region in matters involving complex property division. Our attorneys work closely with forensic accountants, professional appraisers, business valuation experts, and others to identify all of the marital assets and debt, find hidden assets and frame our clients' cases as strongly as possible.

- Business Valuation
When the division of marital property involves a business, be it a law practice, a medical or dental practice, or a manufacturing or other company, careful attention needs to be paid to how that business is valued. Accurate valuation is a critical issue no matter what side of the case you are on.

- Alimony and Child Support
At the Rosen Law Firm, our divorce, alimony, and child support practice is managed by Robert Rosen, an attorney with more than 30 years of experience dedicated solely to the practice of family law. In one reported case from the South Carolina Court of Appeals, Wooten v. Wooten, Mr. Rosen successfully represented a woman in a case that changed state law regarding life insurance. Mr. Rosen has been involved in hundreds of alimony cases and has handled many appeals cases.

- Child Custody and Visitation
At the Rosen Law Firm, we care enough about our clients to be honest with them and to tell them what they need to hear rather than what they might want to hear about parental rights and child custody law in South Carolina. This is important because getting what you want in a custody situation requires early strategizing that can only take place when clients are fully and honestly informed.
