Practice Areas
Practice Areas Description
- Anesthesia MalpracticeWhen physicians or anesthesiologists fail to prescribe the correct dosage, protect against possible reactions, question a patient carefully on other medications they may be taking, or carefully monitor the patient's conditions, this negligence can quickly result in dangerous situations. If you or a family member has been harmed as a result of negative drug interactions, incorrect prescriptions or dosages, or another anesthesia drug complication, you may be entitled to compensation.
- Birth Injury
Regrettably, sometimes during the course of the birthing process an infant may suffer an injury or deformity that is directly related to the delivery process. Most birth injuries do not result from medical malpractice. The majority of delivery doctors and assisting hospital staff follow acceptable procedures, and a provider is not negligent simply because his or her efforts were unsuccessful. The act of childbirth is a wondrous gift which is sometimes marred when a baby experiences major problems, mishaps and errors, which should not have occurred, and may result in serious physical and/or developmental issues for the infant. Birth related injuries vary greatly, in that some are very minor and heal over time, some may require surgery, and others may require a need for lifetime care and may even result in a casualty and/or death. Birth injuries can result in Cerebral Palsy and Erb's Palsy.
- Brain Injury
Every year in America, nearly 100,000 people suffer brain injuries that permanently affect their ability to work and do the simple tasks necessary for daily living. Surprisingly, one does not have to be traveling at a high rate of speed or have one's head strike an object, such as a steering wheel or windshield, to suffer a traumatic brain injury. Mild brain injuries can be caused by falls, car accidents or sport-related activities. Trauma to the head or neck region can cause the brain to bruise, bleed, tear, and/or swell. There are two general types of head injuries, open or closed. An open injury means the skull has been fractured, while a closed head injury does not involve a fracture. Both types of brain injury can cause paralysis, loss of vital body functions and death.
- Breast Cancer Misdiagnosis / Delayed Diagnosis
Breast cancer is a devastating diagnosis, regardless of the progression of the cancer. However, the chances of surviving breast cancer for at least five years are clearly linked to receiving an early diagnosis. Mismanagement of records, misreading mammograms, misdiagnosis of the disease, or underestimating the severity of a lump are some of the more common errors. Delayed diagnosis and treatment of breast cancer can be fatal. When cancer is diagnosed late, the patient is more likely to die. An early diagnosis can mean difference between life and death. Later diagnosis almost always results in significantly more tissue loss, more invasive procedures, and considerable loss of well being due to aggressive chemotherapy and radiation.
- Burn Injuries
At the Burn Injury Law Firm of Rosenberg, Minc, Falkoff & Wolff, we have extensive experience representing victims of burn injuries, including electrical burns. We handle burn injury claims throughout the New York State and City areas, including the boroughs of Manhattan, Queens, Brooklyn, Staten Island, and the Bronx. Severe burns can result from a variety of circumstances, including: chemicals, defective household products, defective household appliances, house and building fires, vehicle fires, drain cleaners, defective industrial equipment, spilled food and beverages, power lines, medical accidents, explosions, electrical arcs, chemical exposure and job-related accidents.
- Medical Equipment Failure
Medical equipment in the hospital and doctor's office setting is relied upon more and more for the life and safety of the patient. Faulty monitoring can lead to serious harm or death. Many monitoring devices must be equipped with a failure mode or an audible alarm which can alert physicians and hospital personnel in the event of any malfunction. It is of utmost importance that hospitals follow their regulations and a proper standard of care with regard to checking that machines properly function and that machines are safe for patient use.
- Hospital Negligence
When reasonable care is not taken to prevent injury to a hospital patient, the end result can be a form of medical malpractice called hospital negligence. Exposure to hazards, substandard care, unclean facilities, and tainted instruments are a few examples of hospital negligence. Hospitals are responsible for providing healthcare that is beneficial to patients. Unfortunately, hospital negligence is not a rare occurrence. For a review of your hospital negligence medical malpractice case.
- Hospital Injuries
The negligence or failure of a hospital or other medical facility can have injurious or fatal results. At Rosenberg, Minc, Falkoff & Wolff, LLP., we handle all types of cases related to medical negligence, including the failure to diagnose diseases, emergency room and surgical errors, negligent testing, inappropriate specialist referrals, birth-related injuries and improper standard of care generally. Serious injury or death may result from a hospital or emergency room's failure to diagnose diseases, such as cancer or meningitis, or the failure to make an appropriate medical specialist referral. Medical care professionals at hospitals handle most births and deliveries properly, but medical negligence can occur in that context as well. When patients are sent home from the emergency room with inadequate treatment, the consequences can be grave.
- Medical Misdiagnosis
Medical Misdiagnosis is a serious risk every time you go to the hospital. Medical treatment does not come with the guarantee that everything will be handled at one hundred percent capacity. Doctors, nurses, surgeons, and all other kinds of medical professionals have a standard quality of care. But sometimes this standard is subverted and the patient suffers. Medical malpractice is a serious offense to the standard of health care in this country. When you go to the hospital, the last thing on your mind is the doctor making a mistake. Although infrequent, this happens. And sometimes the medical professionals negligently misdiagnose a patient. This can result in giving a patient medication that may be harmful, and even fatal.
- Nursing Home Negligence
When you take an elderly relative to a nursing home or to the hospital for a visit, the last thing on your mind is whether he or she is going to be taken care of. It is a given in this country that we treat our elders deservingly. The health and elder care professions have set a high standard of quality. But sometimes this standard is subverted. There are many ways physical elder abuse can present itself, such as: bed sores, malnutrition, dehydration, negligence in failing to restrain a disoriented patient, bruises, broken bones, medication errors including wrong dosages and wrong medications, failure to diagnose and treat pneumonia and poor hygiene.
- Prescription Drug Malpractice
A 1990 study of prescribing medication errors in teaching hospitals detected an estimated 3.13 errors for each 1,000 orders written, and a rate of 1.81 significant errors per 1,000 orders. The high number of orders and the hectic nature of general and teaching hospitals makes it quite a task to get all of the medication and prescription orders correct. The quality of healthcare and medication is very high in this country with superb standards other countries observe and assimilate into their own healthcare systems. When medication errors occur and result in personal injuries and fatalities, it is a blight not only to our medical system but to our country itself.
- Surgical Mistakes
Every time a person has to undergo a surgical operation there are risks of medical and surgical malpractice. One form this kind of medical malpractice can take is in surgical errors. Surgical errors may range from consequences stemming from pre-operative care to perforations of internal organs by a surgical utensil during the performance of surgical procedures. There are numerous circumstances that may arise while on the operating room table that may lead to a faulty surgical performance or flawed surgical performance. Surgical errors may occur in any kind of medical procedure involving intrusive and non-intrusive surgery. Even the simplest of cosmetic surgical procedures may result in a surgical error.
- Wrongful Death
Wrongful Death is defined as the death of an individual as a direct result of the negligence of another individual, company, or entity. Elements of Wrongful death suits involve the cause of death, who is strictly liable for the death, and who can claim the wrongful death. Wrongful death claims are usually sought after by relatives, siblings, or members of the decedent’s estate who have lost a considerable amount of money (wrongful death damages) due to the wrongful death of the decedent. Some common things to expect when one has experienced a wrongful death can range from loss of income to sorrow. Mental anguish, loss of companionship, and large hospital bills can also debilitate you physically as well as mentally.
