Practice Areas

Additional Practice Areas: Police Brutality, IRS Whistleblower Rewards, SEC Fraud, Whistleblower Rewards

Practice Areas Description

- Police Brutality

As private citizens, we generally trust police officers to act appropriately to protect our safety but there are times when this trust is misplaced or this trust is abused by a peace officer who goes too far. The United States Constitution protects individuals from the use of excessive force by police. Excessive force is simply using greater force than is necessary under the circumstances, for example, physically assaulting or beating someone, shooting an unarmed individual, or otherwise harassing someone, while placing that person under arrest as well as while that individual is in police custody.

- Whistleblower Reward and Protection Act

The Illinois Whistleblower Reward and Protection Act (740 ILCS 175/1) was enacted in order to protect individuals who uncover fraud against the government and to reward and encourage individuals to monitor and report fraudulent behavior. Violations involving Medicaid fraud, Medicare fraud, or defense contracting are the most common forms of government fraud. Individuals who report or 'blow the whistle' on these acts of fraud are commonly referred to as whistleblowers and are entitled to receive an award under the Illinois Whistleblower Reward and Protection Act and the federal False Claims Act.

- Criminal Defense

Being charged with a criminal offense can have serious life-altering consequences and it is imperative that you hire experienced legal representation to aggressively defend your case. At Rosenblat & Associates, we have 20 years of experience representing individuals who have been charged with a wide range of white collar crimes, drug crimes and battery-related charges including:

Theft
Drug Possession
Drug Trafficking
Assault
Battery
Sex Crimes
Internet Crimes
Possession of Child Pornography

- Health Care Fraud

Whistleblower lawsuits, under the False Claims Act, are also known as qui tam law suits. These lawsuits encompass fraud committed against any government agency including health care fraud committed by hospitals and fraudulent billing of pharmaceutical products. Pharmaceutical fraud involves violations such as pharmaceutical kickbacks and use of off-label drugs or equipment. Health care fraud pertains to overbilling of services and upcoding hospital visits into more expensive services than were actually provided. The individuals that end up reporting these fraudulent billing practices are often employees or former employees of the entity billing Medicare or Medicaid.

- IRS Whistleblower Rewards

It's not uncommon for organizations and businesses to take steps to reduce operating costs, expenses, and 'overhead.' Unfortunately, underpaying taxes is sometimes used as an option to do so. Whistleblowers who report these illegal acts are according to the IRS Whistleblower statute (26 U.S.C. 7623), may be entitled to a reward. These rewards may be up to 30% of the amount collected.

- SEC Fraud

The Securities and Exchange Commission (SEC) is an enforcement authority that brings civil enforcement actions against businesses or individuals for violations of securities laws. Acts of fraud can come in a variety of forms. The most common fraudulent acts involve accounting fraud, falsifying documents, insider trading or other acts involving securities fraud. The individuals who report these illegal or fraudulent acts are often referred to as whistleblowers and they may be entitled to an award for reporting the fraudulent activity. Chicago SEC Whistleblower attorney Michael C. Rosenblat represents individuals who have come forward with information that leads to a successful enforcement action against someone committing securities fraud.

- Whistleblower Rewards

The Commodity Futures Trading Commission is a government agency that is intended to protect the public from fraudulent or manipulative business practices related to sales within financial and commodity markets. Similar to the Securities and Exchange Commission (SEC), the CFTC collaborates with law enforcement agencies in order to uncover fraudulent business practices that violate the Commodity Exchanges Act (7 USC 1).

- False Claims Act

The Whistleblower Reward and Protection Act (WRPA), 740 ILCS 175/1, et seq., is based on the federal False Claims Act (FCA), 31 U.S.C. §3729, et seq. Both of these statutes authorize a private person, the whistleblower, to sue, on behalf of the government, a company or persons attempting to defraud the state or federal governments. These whistleblowers may then be eligible for an award. These suits brought by whistleblowers, or relators, are known as "qui tams." "Qui tam" is short for "qui tam pro domino rege quam pro se ipso in hac parte sequitur," which means "who pursues this action on our Lord the King's behalf as well as his own."
