- Criminal DefenseCriminal charges are not to be taken lightly. A conviction will change your life forever. In many ways, your life as you know it hangs in the balance. We want you to know that there is a way out. At the Rosengren Kohlmeyer Law Office, we can defend you against criminal charges, including either obtaining a not guilty verdict, getting the charges dismissed or minimizing the damage of a conviction on your life.
- DUI / DWI Charges
Driving under the influence (DUI) or driving while intoxicated (DWI) charges are very serious. A conviction could bring up to three years of mandatory jail time (or prison time for multiple offenses), heavy fines, loss of your driver's license, job loss and a ruined reputation in the community. Another common result that most people don't know about is that Canada won't let you in if you have a DWI. For hunters, fishermen and vacationers to Canada, this could be a serious penalty.
- Field Sobriety Tests
In many cases when the police pull someone over for drunk driving, they will make the driver perform certain tests, called "field sobriety tests", to help determine whether the driver is indeed impaired. There is almost always some kind of mistake made by the police that we can use to help get the evidence deemed inadmissible. Without this evidence, the state's case will be weakened tremendously.
- Drivers' License Defense
The right to drive is important to almost everyone in this country, and it is especially important to professional drivers. You will lose your driver's license or Commercial Driver's License (CDL) upon arrest for DUI. Separate from the trial you will face in the criminal system, you will have to defend your license in an administrative process with the Minnesota Department of Transportation (DOT). We will represent you in every aspect of your drivers' license restoration case, including timely petition filing, representing you at all administrative hearings and handling your Petition for Judicial Review, to have a judge review and possibly restore your driving privileges.

he Minnesota legislature takes drug crimes very seriously. Most people facing drug charges for the first time in this area are quite surprised to learn how much is at stake in defending against these charges: Prison time: Cocaine possession is a particularly serious offense, bringing up to 86 months in prison for a first offense. Sale of cocaine or marijuana will bring felony charges, as well. Fines and loss of property: It is common for the county attorney to seize the house, car and other possessions of someone accused of drug crimes. If someone used any money received from a drug deal to pay the mortgage, for example, that house could be seen as the fruits of a criminal enterprise and seized as a result. Many of our clients are surprised to learn that there is no automatic presumption in favor of one parent or the other regarding child custody. Most people assume that, barring exceptional circumstances, the mother will automatically get custody of the children. This is not the case anymore. The court is focusing more on "parenting plans," in which the mother and father have a fairly equal chance for physical custody (where the child is housed) and shared legal custody (making important decisions regarding the child).

Spousal support and spousal maintenance (formerly called "alimony") is a murky issue in Minnesota, to say the least.
