- Employer Workers Compensation Fraud
A employer who knowingly fails to insure its workers compensation liabilities is guilty of a class A misdemeanor and may be liable to the state of Missouri for a penalty of up to three times the annual premium or up to fifty thousand dollars, whichever amount is greater. A subsequent violation is a class D felony. Failure to maintain workers compensation insurance should be reported to the Fraud and Noncompliance Unit of the Division of Workers Compensation.
- Workers Compensation Insurance Fraud
Any person may file a complaint alleging insurer fraud with the Workers Compensation Fraud and Noncompliance Unit. All investigations conducted by the Fraud and Noncompliance Unit are criminal in nature and must be kept confidential. Due to the confidentiality of the investigations, persons lodging complaints are not provided information on the outcome of the investigation prior to prosecution. If the investigation reveals a violation of the statute, the Workers Compensation Fraud and Noncompliance Unit present the findings of fraud to the director of the Division of Workers Compensation. The director may refer the case to the Missouri Attorney General for prosecution.
- Employer Noncompliance
Every employer who is subject to the requirements of the workers compensation law must insure its entire workers compensation liability with an insurance carrier that is authorized to insure such liability in the State of Missouri by the Missouri Department of Insurance or qualify to be a self-insured employer by the Division of Workers Compensation. Noncompliance is the failure of the employer to carry workers compensation insurance when required to do so under the law.
- Workers Compensation Appeals, Rights and Procedures
Upon being issued an award from the administrative law judge, the employee has the right to file an application for review with the Labor and Industrial Relations Commission within 20 days of receiving the workers compensation award. Appeals of workers comp cases are complex legal matters that require extensive experience. - Construction Industry
If your company erects, demolishes, repairs or alters any structure, you are mostly likely in the construction industry. Missouri normally requires employers with 5 or more employees to carry workers’ compensation insurance. The definition of “employee” includes both full and part-time employees, and includes every person in the service of an employer under any contract of hire, express or implied, oral or written, or under any appointment or election, including executive officers of a corporation. Employers in the construction industry have stricter requirements and are required to carry workers comp insurance with just one or more employees.
