If you have been arrested for a crime, but were not subsequently charged, you should seek expunction. If you were charged, but the charges against you were dismissed due to lack of probable cause, insufficient evidence or unavailable witnesses, you should seek expunction. If you completed a deferred prosecution or pre-trial diversion, you should seek expunction. If you were found not guilty by a judge or jury, you should seek expunction. If you were placed on a deferred adjudication for a Class C misdemeanor, you should seek expunction. If you plead guilty to a Class C alcohol crime, you should seek expunction.

- Assault
Assault is a crime that does not require physical contact between the accused and the alleged victim. All that is needed for an assault charge to be filed is for someone to have a reasonable fear of bodily injury. In Texas, assaults can be charged as either misdemeanors or felonies. The circumstances of the crime determine the charge as follows:
• Simple assault—Assault that causes minor injury. Charged as a Class A misdemeanor and punishable by up to a year in jail and up to a $4,000 fine.
• Third-degree felony assault—Assault involving domestic relationships, public servants, government contractors, security guards or emergency workers. This charge is punishable by 2 to 10 years in prison and up to a $10,000 fine.
• Second-degree aggravated assault—Assault with a weapon and/or causing serious bodily injury. Punishable by 2 to 20 years in prison and up to a $10,000 fine.
• First-degree aggravated assault—Assault with a weapon that involves a domestic relationship, public official, security guard, witness to a crime or an informant. Punishable by 5 years to life in prison.

Penalties for felony drug crimes range from 2 to 99 years in prison and fines up to $50,000. Besides jail time and expensive fines, a conviction on a drug crime can trigger a driver’s license suspension and can lead to police seizing your vehicle.
