Practice Areas Description

Rothman & Associates, P.A. offers legal representation and services in the following areas of practice:

- White Collar Crime

Regardless of whether you are currently under investigation or have already been charged in a criminal case, it is essential that you avoid talking to police or prosecutors until you consult a lawyer. Since white collar crime usually involves financial mismanagement, fraud, or bribery, prosecutors often introduce conspiracy charges against the accused as well. Once conspiracy charges are introduced, hearsay rules protecting you from unsubstantiated claims and statements made by others charged, is suspended: alleged statements attributed to you by other suspects can be introduced as evidence against you at trial.

At Rothman & Associates, our criminal defense lawyers act immediately to protect the rights and interests of our clients. We hire forensic accountants, private investigators, computer experts, and handwriting analysts in evaluating and the evidence against you and preparing your defense. We're prepared with the resources needed to undermine the prosecution's version of events, expose contradictory evidence, and identify illegally-obtained statements and records.

- Fraud

From our firm’s offices in Miami-Dade County, Florida, fraud defense attorneys represent individuals, corporations, corporate officers, directors, and employees throughout the United States against all types of fraud charges. Rothman & Associates defends clients in cases investigated by federal, state and local agencies.

- Violent Crimes

Homicide
If you are found guilty of homicide in Florida, you face a long prison sentence or the death penalty. The Miami criminal defense lawyers at our south Florida law firm, led by board-certified criminal trial specialist David Rothman, are prepared to provide powerful defense counsel for clients facing murder charges.

If you are charged with, or have been arrested for, homicide, you may seriously damage your case by talking with police or investigators before consulting with a lawyer. Your statements can and will be used against you later in court. Be polite, and be firm: you want to speak with an attorney before answering questions.

Assault & Battery
If you have been charged with assault or battery, you may face jail time if convicted. The consequences of conviction for a violent crime are serious, and may include jail or prison time, a fine, probation, loss of employment, or loss of a professional license.

You are at risk of incriminating yourself or making irreversible mistakes if you discuss an incident with police before speaking with an attorney. Contact our Miami criminal defense firm if you would like to arrange a consultation and discuss an assault and battery defense with a lawyer.

- Internet Crimes

The FBI has special Internet agents, and federal prosecutors have teams of attorneys working exclusively on Internet crime. Even if you have done nothing wrong, or didn't know you were involved in an illegal activity, you may be at serious risk. If you are under investigation or have been charged with Internet crime, seek legal advice at the earliest opportunity. Please contact our Florida criminal defense law firm if you would like to discuss your situation with one of our attorneys. We serve clients throughout the United States from our Miami-Dade County office.

- Child Pornography

You can be prosecuted for downloading allegedly pornographic or obscene materials, such as child porn, at home or at work, or with possession of such materials. Depending on the charges and the evidence, we may defend you by showing that the material was not obscene and therefore not illegal, that the wrong person was arrested, or that the evidence was collected in an illegal search and seizure, and therefore inadmissible. Charges involving possession or distribution of child pornography can destroy your future if not handled appropriately. Make sure you have a skilled lawyer on your side.

- Online Child Solicitation

When investigating charges involving the solicitation of a minor over the Internet, our firm evaluates techniques that law enforcement used in obtaining evidence. Many times, these cases arise from an online conversation between the individual and an undercover agent in an Internet chat room. We work to prove that the conduct was illegal entrapment and that the evidence, therefore, cannot be used against our client.

- Internet Fraud / Cyber Fraud

Charges of using the Internet to commit fraud may stem from solicitations for online investments, alleged pyramid scams or offers to employ people to work from home, particularly if the offer suggests a guaranteed return. One aspect of our investigation as defense counsel would be to examine the charges and the evidence to determine if government agents working undercover on the Internet actually engaged in illegal entrapment. Other computer fraud charges involve online identity theft and credit card fraud.

- Internet Gambling

One of the largest online economic activities is Internet gambling. Sometimes it is unclear whether the activities are illegal. If this factor is in dispute, our lawyers will work with you to gather proof that no crime has been committed.

- Online Pharmacies and Drug Sales

Our lawyers have represented pharmacies and doctors accused of illegal involvement in online sales of prescription drugs.

- Drug Offenses

Narcotics Crime
Our attorneys take a proactive, aggressive approach to defense against drug charges, working to get charges reduced or dropped, challenging evidence obtained through illegal search and seizure, and taking all other measures to protect our clients’ rights.

Manufacture / Cultivation of Marijuana
Have you been accused of operating a marijuana grow house? Grow houses have been popping up all over Florida and all over the nation. As a result, law enforcement has intensified investigations. They are reviewing electrical usage and water usage to determine if excessive amounts are being used - creating suspicion that the manufacture/cultivation of marijuana is being carried out on the premises. If you are under investigation or have been arrested and are facing drug manufacturing charges, you need experienced legal counsel on your side. The attorneys at Rothman & Associates can assist you.

- RICO Violations

We provide clients with the thorough and aggressive representation necessary for an effective defense against state and federal charges prosecuted as RICO violations. Our Miami defense attorneys include board-certified criminal defense specialist David Rothman. Please contact our office to make arrangements if you would like to speak with one of our lawyers about a RICO investigation.

When criminal charges are prosecuted under RICO, the accused faces far more serious consequences than otherwise. If each of several individuals is charged with a relatively minor drug violation, each may face a maximum sentence of as little as one year. When a prosecutor combines the charges into one RICO case against a group of individuals, and alleges they are acting as an illegal enterprise, each individual is now at risk of serving over a decade in prison. These trials are long and complex, more evidence is assembled against the accused than in other cases, and the cases often are prosecuted by teams with the backing of powerful state and federal agencies.

- Sex Offenses

We are prepared to handle cases involving sex crimes including: so-called date rape, felony sexual assault, child rape, child molestation, incest, sexual misdemeanors, marital rape, Internet pornography, solicitation, prostitution, lewd and lascivious behavior, and non-compliance with the sex offender registration law (a third degree sex offense).

- Theft & Property Crime

Our criminal defense lawyers aggressively defend clients against a full range of crimes against property.

Defense attorneys at our firm provide equally aggressive representation to every client, regardless of the degree of the charges. It is important that you contact a criminal trial lawyer at the earliest opportunity if you are involved in a criminal investigation. From early advice on how to avoid self-incrimination, through pre-trial motions to have charges reduced or dropped, and at trial, we are determined to get the best outcome possible for our client.

- Conspiracy

A conspiracy case is considered the “darling of the prosecutor” - if a prosecutor alleges and proves conspiracy, statements of co-conspirators can be used as evidence. Hearsay rules intended to protect the rights of the accused often do not apply in conspiracy cases. Conspiracy charges can be added to a case when two or more people are accused of having planned to commit a crime. Almost all federal criminal cases will include conspiracy charges.

If you are convicted of participating in planning a crime you may face the same penalties as the person who actually committed the crime. It may not even matter that the crime was never committed. The rules of evidence and the trial process seemingly are weighted to favor the prosecution. The conspiracy defense lawyer trying your case needs to know what to expect and how to counter it in order to protect your rights.

- Smuggling of Illegal Immigrants

Florida has one of the largest coastlines in the United States. With such a large coast, Florida has become a hotbed for illegal immigrant smuggling. If you have been arrested in Miami, the Florida Keys or anywhere else along Florida's borders for assisting an illegal alien with unlawful border crossing, you may face serious federal charges and penalties. An experienced criminal trial attorney can provide you with the aggressive representation that is necessary to protect your rights.

We are known for our experience and dedication. In over 25 years of practice, our firm has earned the trust and respect of clients we have defended.

- Felony Traffic Offenses

Felony traffic convictions can result in sentences including expensive fines, community service, a criminal felony record, and substantial jail time. At Rothman & Associates, our criminal defense attorneys are committed to reducing the charges or sentence against you in felony DUI and felony traffic violations cases. Depending on the circumstances of your arrest and your driving record, our attorneys may be able to have the charges against you reduced or negotiate a lighter sentence. We understand how to work with the court in exploring alternatives to jail, the loss of your license, and extensive fines. In cases involving hit and run or repeat felony DUI, our lawyers work with investigators and eyewitnesses in order to undermine the allegations against you. At each stage in the process, we keep you involved and informed so you understand the options available and the potential outcome of a trial.

- Serious Domestic Crimes

We handle Florida domestic violence charges involving spousal abuse, child abuse and other domestic abuse. Domestic violence charges can arise from allegations of:

* Physical abuse
* Verbal abuse
* Emotional abuse

- Property and Asset Forfeiture

Under provisions contained in the Racketeering Influenced Corrupt Organizations Act (RICO) and other state and local legislation, law enforcement officers and the government can seize property and assets they believe have been acquired through proceeds from illegal activity. Since forfeiture initiatives are handled in civil rather than criminal court, even if you are acquitted of all criminal charges you can still lose your home, car, or assets under a RICO or forfeiture action connected with your criminal trial.

At the law office of Rothman & Associates, our attorneys impede government and law enforcement seizures by intervening as earlier as possible. While our lawyers work with forensic accountants and private investigators in collecting evidence in support of our client, we also expose misconduct and constitutional violations on the part of investigators and federal agents.

- Grand Jury Representation

Due to the nature of a grand jury, those called to testify before them cannot be accompanied by legal counsel into the court room. A grand jury provides a legal setting for prosecutors to present evidence in seeking an indictment on criminal charges against the accused. Depending on the nature of the charges involved, it may be in your best interest to retain legal counsel if you are called to testify before a grand jury.

Our lawyers explain how a grand jury works, what legal issues are involved, and how you can protect yourself while providing testimony. Especially in federal cases where prosecutors may introduce conspiracy charges or engage in a "fishing expedition," understanding what you can and cannot say without perjuring yourself is essential. We also counsel you on your constitutional right against self-incrimination and whether or not you should refuse to answer questions in the grand jury room.
