Law Firm Overview Free Consultation

Rozek Law Offices, S.C. is devoted to helping personal injury victims in their search for justice. We limit our practice to the representation of people that have sustained serious Wisconsin Personal Injuries as a result of negligent or wrongful conduct. Our law firm's primary objective is to protect the rights of our clients by aggressively advocating on their behalf. We also author books in an attempt to educate all Wisconsin Personal Injury Victims, before they do anything that could jeopardize their case.

Rozek Law Offices is unique in the sense that we intentionally limit the number of clients we represent at any one time. We limit our representation in two ways. One, we only represent clients that have been involved in certain types of Wisconsin Accidents. Two, we only represent clients that have sustained serious Wisconsin Personal Injuries.

The overall goal of Rozek Law Offices is to do as much good for each individual client as possible. Representing everyone that would like their help is just not possible because it would not allow them to give each of their clients their most dedicated and focused effort. It is their focus on specific types of accident cases, specific types of injuries, and intentionally limiting their caseload, that separates Rozek Law Offices from most other Wisconsin personal injury lawyers.

Practice Areas Description

Rozek Law Offices provides legal assistance on Personal Injury cases including:

- Car Accidents

If you have been involved in an automobile crash, you can assume that someone was at fault for causing the crash. The key to establishing who is at fault in causing a crash is dependent upon the gathering of crucial information at the scene of the crash. This evidence can be in the form of witness observations and statements, in the form of physical evidence such as the damage to vehicles or skid marks left at the scene, or the evidence may be in other forms. An experienced Wisconsin personal injury attorney may be able to overcome a poor investigation by the officer on the scene.

- Truck Accidents

Collisions due to wrongful acts of truck drivers and trucking companies are all too common in the United States. Recent statistics indicate that nearly 5,000 people are killed and nearly 100,000 are seriously injured each year as a result of accidents involving large trucks. Federal and State governments have enacted laws and safety regulations requiring trucking companies and their drivers to take certain precautions in an attempt to make the roadways safer. The single leading cause of Wisconsin Truck Accidents is Truck Driver Fatigue.

- Drunk Driving Accidents

Too often I have seen Wisconsin lawyers handle Wisconsin Drunk Driving Accidents as they would any other auto accident case. They should not be handled the same. The Wisconsin Supreme Court has stated that victims of Drunk Drivers in Wisconsin can recover Punitive Damages in certain circumstances. Punitive Damages are meant to punish and deter individuals from repeating dangerous actions. A thorough investigation of the circumstances surrounding a Wisconsin Drunk Driver's conduct is absolutely critical to determine whether Punitive Damages are appropriate in a given crash.

- Bus Accidents

Buses are considered common carriers, which means bus drivers and bus companies owe their passengers a greater duty of care in protecting them from harm. Driving a bus requires special training. The buses must also be checked regularly to ensure they are operating safely. Bus crashes are usually due to the bus driver violating the rules of the road, fatigue, driving too many hours, cell phone use, the use of drugs and alcohol, inattentive driving, inadequate training, improper inspection of the bus, unsafe equipment, or tire tread separation. A detailed investigation by an experienced investigator and trucking lawyer will reveal the truth behind the cause of the crash.

- Motorcycle Accidents

The most common reason for motorcycle accidents is the inability of other drivers to see the motorcyclist. The vast majority of motorcycle accidents occur at intersections and the majority of motorcycle accidents are not due to the fault of the motorcycle driver. At Rozek Law Offices we have experience handling Wisconsin motorcycle accident cases. Attorney Rozek began riding motorcycles as a child and has continued his love for motorcycles as an adult. We have aggressively fought the most common defenses in motorcycle accident cases, the motorcycle was speeding or the motorcyclists were not wearing helmets. Fortunately, we have had success overcoming these defenses through our use of nationwide experts.

- Pedestrian Accidents

Wisconsin requires pedestrians to obey the Rules of the Road, just as automobile operators. Pedestrians must yield to automobiles when crossing a road if there is no intersection or crosswalk or if the pedestrian does not have a green or "walk" signal and where the automobiles do have a green signal. Pedestrians must also walk on a sidewalk if one is available. If no sidewalk is available, then pedestrians must walk on and along the left side of a highway. The most common defense used in pedestrian cases is that the pedestrian "came out of nowhere." We have successfully defeated this defense in past cases through the use of accident reconstruction experts and human factors experts. Our experts have been able to establish that the driver of the automobile was simply not paying proper attention.

- Bicycle Accidents

Bicycling is an excellent means of transportation, even in Wisconsin's climate. The benefits of bicycling are numerous: health, environmental impact, economical, etc. Unfortunately, bicycle accidents can result in catastrophic injuries. Each year there are over 1,000 Wisconsin bicycle crashes that result in serious injury or death to the bicyclist. Fortunately, bicycle crashes in Wisconsin have declined for the past several years. The most likely reason for this decrease is an increase in properly designated bicycle lanes as well as increased education about bicycle safety. The majority of bicycle crashes occur in Milwaukee County and Dane County, where it is quite common for bicyclists to commute to work. Most serious Wisconsin bicycle accidents occur between a car and a bicycle.

- Taxi Cab Accidents

Taxi Cab Drivers perform an important function in today's economy and modern society. Our government and legislature has recognized the importance of Taxicab companies and weighed that against the importance of protecting the health and safety of the public. As a result, Taxis and Cabs are considered Common Carriers. Common Carriers are held to a higher standard of care than other drivers. In Wisconsin, while Cab drivers are not required to guarantee the safety of their passengers as this would be impossible, but Cab drivers must exercise the highest degree of care for the safety of their passengers. Wisconsin law defines a Cab Driver's Highest Degree of Care as the following: The care required is the highest that can be reasonably exercised by Cab Drivers of vigilance and foresight when acting under the same or similar circumstances, taking into consideration the type of transportation used and the practical operation of its business as a common carrier.

- Dangerous Property Accidents

Dangerous property injury accidents, also referred to as "Wisconsin Slip and Fall Accidents," "Wisconsin Trip and Fall Accidents," and "Wisconsin Premises Liability Accidents," usually result in minor cuts and scrapes. These injuries can occur due to a variety of reasons that make property unsafe, including but not limited to the following: unsafe flooring, such as improperly secured floor mats, unleveled flooring surfaces, ice or snow buildup, or cracked steps or floors; weakened floor boards; improperly maintained premises; inadequate security; inadequate warning signs; falling objects such as ice, facade, or construction tools; inadequate slip resistance surfaces, especially in areas known to be slippery such as entrances, bathrooms, or bathtubs; or foreign substances left on floor for an unreasonable amount of time.

- Nursing Home Neglect

Many families face difficult choices as loved ones age. Perhaps the most serious decision is whether to place a loved one in a nursing home. The decision to trust a nursing home with the care of a loved one is a decision that is never taken lightly. Unfortunately, all too often, nursing homes do not provide adequate care for our loved ones. It is impossible for loved ones to visit their family members 24-hours a day. Oftentimes, when the family members are not present, their loved ones are neglected and abused. The elderly are especially susceptible to poor care. The most common types of injuries sustained by nursing home residents are the following: Bed Sores; Falls; Broken Bones; Concussions or Traumatic Brain Injuries; Cuts, Scratches and Bruises; Dehydration; Malnutrition; Infections - Staph (Staphylococcus), C. Diff. (Clostridium difficile); Sepsis; Over-Medication; Improperly Administering Necessary Medical Treatment or Monitoring - blood sugar checks, dialysis, etc.; Sexual Abuse; Physical Abuse.

- Dog Bites

There are an estimated 75 million dogs in the United States. The Centers for Disease Control has estimated that nearly 5 million people are bitten by dogs each year. Approximately, 1000 people visit hospital emergency rooms each day due to dog bites. Unfortunately, the majority of dog bite victims are children, half of which are bitten in the face. Dog bites account for the fifth most common reason for children visiting hospital emergency rooms. Children are more likely to be attacked by dogs because of their size. Most dog breeds are instinctually inhibited from attacking someone larger than the dog itself. There is a noticeable exception to this general rule. That is the Pit Bull. Pit Bulls are one breed that statistically attack adults as often as children.

- Product Liability Accidents

Dangerous products in Wisconsin represent a significant threat to the health and safety of adults and children. Personal injuries due to dangerous products are known as Product Liability Law. In general, product liability means the responsibility of the manufacturer or seller of a product for injuries due to the use of the product. All manufacturers are required to make products that are not unreasonably dangerous. They also must warn buyers about dangers associated with the use of their products. If they fail to do either, and their product causes injury, then they may be liable for the injury.

- Construction Site Accidents

Construction sites in Wisconsin can be a very dangerous place for workers as well as the public. The very nature of construction sites is dangerous. There are dangerous obstacles and dangerous tools at every turn. It is critically for contractors to establish and follow specific, well-thought out guidelines for keeping construction sites as safe as reasonably possible. While most injured construction site workers will qualify for Wisconsin Worker's Compensation Benefits, these benefits oftentimes do not provide for full reimbursement of all of the injury victim's damages. Our goal in Wisconsin construction site accidents is to conduct a thorough investigation of the accident to determine if there is the potential for a "third-party" recovery, i.e. is the injured worker able to pursue a case against anyone other than their employer for the full extent of their damages.

- Gas Explosions

Gas tanks, gas valves and gas lines are supposed to be designed not to leak, therefore, if there is a leak and resulting explosion, it is usually safe to assume that someone must have been negligent in causing the leak. Wisconsin gas explosions usually result from negligent design, negligent maintenance, negligent inspection, safety code violations, or Occupational Safety and Health Administration (OSHA) violations. A thorough investigation is required to determine the exact cause of the gas leak and ignition. Our office utilizes a variety of national experts in gas safety to assist in our investigation of Wisconsin gas explosions. Wisconsin Administrative Code Chapter Commerce 40 establishes minimum safeguards to life, health and property through the adoptions of reasonable and effective standards relating to gas systems.

- Aviation Accidents

Wisconsin airplane crashes usually result in catastrophic injuries to pilots, passengers and bystanders. Airplane crashes can be caused by a number of different factors, including: Pilot Error; Engine Failure; Icing - pre-flight and mid-air; Fuel Tank Explosions; Defective Gauges; Airplane Design Defects; Defective Equipment; Mid-Air Collisions; Flight Instructor Errors; Air Traffic Controller Errors; Loading Errors; Fueling Errors; Defective Airplane Maintenance; Airplane Structural Defects; Inclement Weather; Computer Failure.

- Serious Personal Injury

When an individual or a family member sustains a serious personal injury it is important for their attorney to have a deep understanding of the specific injury and what can be expected with the injury victim's recovery and future medical treatment needs. This is one of the main reasons our office has made the decision to limit our practice to certain types of injuries. In order to best serve our clients, we feel it is critical for us to stay abreast of the latest medical, scientific and technological advances in the diagnosis and treatment of certain types of injuries. Rozek Law Offices has experience handling the following types of Wisconsin Injury Claims: Traumatic Brain Injury, Spinal Cord Injury, RSD/CRPS, Post-Traumatic Headache, Post-Traumatic Migraine, Vestibular Disorders, Whiplash Neck Injury, and Back Injury.

- Wrongful Death

Wisconsin Wrongful Death Law defines the circumstances under which a recovery may be had for the negligent acts of another that result in death. Wisconsin courts have ruled that Wisconsin Wrongful Death Recovery is statutory and not at common law. This means that the Wisconsin statutes govern the recovery for such claims. The Wisconsin legislature has also determined who may recover in Wisconsin Wrongful Death Claims. Under Wisconsin law, if an adult is killed, then the deceased's spouse, children, parents, or brothers and sisters (if they were minors at the time of death) may recover. Other family members are not allowed to recover under Wisconsin Wrongful Death Law.

- DePuy Hip Implant Recall

Many lawsuits have already been filed against DePuy Orthopedics, Inc. across the United States. DePuy has initiated a national campaign to attempt to pay doctors to remove the defective hip implant devices and return them to DePuy as opposed to allowing the patient to keep the defective device. DePuy is also requesting that patients sign a medical authorization allowing DePuy to access patients healthcare records. It is important for anyone that has a DePuy Recalled Hip Implant to protect their rights and talk to an attorney, even if they are not having any symptoms at this time. Rozek Law Offices, SC is currently accepting new clients who have received DePuy Hip Implants since 2003.

- Insurance Bad Faith

Consumers purchase insurance to protect themselves if something goes wrong. The following list describes some common types of Wisconsin insurance coverage: Automobile Liability Insurance Coverage; Automobile Uninsured Motorist Coverage; Automobile Underinsured Motorist Coverage; Automobile Medical Payment Coverage; Private Disability Insurance; Private Health Insurance; Homeowner's Insurance; Umbrella Insurance. Sometimes, insurance companies, in their ever-increasing attempt to decrease payouts and increase profits, fail to timely and sufficiently pay benefits to their policyholders with no reasonable basis for delay or denial. In such circumstances, the insurance company is acting in bad faith.

- Pro Hac Vice Admission

Rozek Law Offices oftentimes serves as local counsel for out-of-state attorneys and law firms seeking justice on behalf of Wisconsin injury victims. As we have experience handling cases throughout the United States, we understand how important it is to find experienced, competent local counsel. Wisconsin has a process for admitting out-of-state attorneys referred to as Pro Hac Vice admission. Pro Hac Vice admission is admission to practice before an individual tribunal for an individual case. In Wisconsin, judges have discretionary authority in determining whether to allow an out-of-state attorney to be admitted to practice law on a particular case.

- Statute of Limitations

The Statute of Limitations refers to the time limit for filing a lawsuit. After the Statute of Limitations expires, an injury victim is no longer allowed to seek recourse for their injuries. The Wisconsin Statute of Limitations varies by the type of case. For a typical Wisconsin personal injury accident, the Statute of Limitations is 3 years, meaning an injury victims has 3 years from the date of accident to settle their claim or file a lawsuit. See Section 893.54 Wisconsin Statutes. However, the 3 year limitation can be shortened depending on the circumstances. The Wisconsin Statute of Limitations for a particular claim can vary greatly depending on many circumstances. If you have a potential claim and would like to know the statute of limitations, we can help.
