Founder Dana Stamps' son, bankruptcy lawyer Eric Stamps, focuses his practice primarily on debt relief and bankruptcy legal services to help people get out of debt and back on the road to financial freedom.
When you cannot pay your bills and you feel like you are being crushed under the weight of your debt, you need to know that you still have options and control over your life. Whether you have lost your job, can't pay your credit card bills, have suffered significant financial loss from medical or hospital bills or had a costly divorce, there is a way out of debt through bankruptcy.
The legal team at Stamps & Stamps, Attorneys at Law, has helped thousands of clients file for Chapter 7 bankruptcy or Chapter 13 bankruptcy to overcome financial challenges, re-establish their credit and regain their peace of mind and financial footing. We believe we can help you, too.
All bankruptcy lawyers are not created equal. Attorney Eric Stamps spends more time than most with clients on the front end to explore their options and make sure they are comfortable with the daunting step of filing for bankruptcy. He commonly hears from clients that other lawyers they talked to were curt, condescending and rude. They express appreciation that our lawyer and staff members were nice to them, straight with them and willing to address their specific concerns.
We understand that you have questions and anxieties. We understand that you are stressed and maybe embarrassed. We are not here to judge you or make money off your troubles; we are here to help you have the best possible outcome, through bankruptcy or alternative solutions. We can help you save your home from foreclosure and get true relief from debts and creditors.
Practice Areas
Practice Areas Description
- Chapter 7 BankruptcyIf you have been unable to pay your bills and cannot see your way out from under your debt, Chapter 7 bankruptcy may be a wise choice. Chapter 7 bankruptcy protects you from your debt and from the harassment of creditors. Chapter 7 gives you the breathing space you need to find a path out of debt. All of your unsecured debt will be discharged, with certain exceptions. The law office of Stamps & Stamps, Attorneys at Law, can help you understand your rights and your obligations related to filing for bankruptcy.
- Chapter 13 Bankruptcy
Chapter 13 bankruptcy is essentially a debt-repayment plan that allows you to repay your debt through a court-ordered reorganization plan, based on your submitted financial documents. It is not a way to break your back or punish you. It is a way to hold the creditors at bay so that you can get back on your financial feet. All of your debts are lumped together into this plan, so that instead of paying many different creditors, you are paying one monthly lump sum to the bankruptcy trustee, who will distribute the payment to your creditors.
- Foreclosure
The financial hardships that people are facing have affected them where they live, literally, in their own homes. The homes they have worked so hard for are being lost. The number of people who have lost homes through foreclosures is deeply troubling. At the law offices of Stamps and Stamps, Attorneys at Law, we know you have options; well before any negative actions are taken to foreclose upon your home. The sooner you reach out for help, the better off you will be and the less it will cost you. If you contact us for help when the sheriff's sale is just a week away, the foreclosure can still be stopped, but it will be more costly to do so. You should get help as soon as you fall behind in your mortgage.
- Wage Garnishment
Wage garnishment is when a creditor legally gets permission to take some portion of your paycheck to pay off a debt that you owe. By law, a creditor must inform you that they intend to take money from your paycheck. They have to file a lawsuit in order to get a judgment against the debtor. If they do obtain the judgment, then your money can be deducted from your paycheck in as little as fifteen (15) days If you are facing this possibility or your wages are being garnished, immediately call or email us for a free consultation. This will continue until the debt is paid off or until you take action to stop the garnishment, such as filing for bankruptcy.
- Auto Repossession
People lose jobs. They go through a costly divorce. They get sick. These unfortunate events are part of life. Just because you are in financial trouble does not mean that you must suffer even more by giving up your car and living under a crushing burden of debt; nor should you suffer any longer than you have to. If you have fallen behind in your car payments, it is important that you speak to an experienced and trustworthy lawyer immediately to learn of your legal options and to obtain guidance to assist you in finding a path out of debt. You need to speak to an attorney at Stamps and Stamps, Attorneys at Law.
- Creditor Harassment
In Dayton, Ohio and throughout the United States, bill collectors have been known to resort to all kinds of cruel tactics to collect on unpaid bills. Some bill collectors violate the Fair Debt Collection Practices Act and threaten to have the debtor arrested, even though this is unlawful. Some even call the debtor's relatives or neighbors to tell them about the unpaid debt (which is also illegal). All of them will regularly call your home to collect on a debt. Those phone calls are stressful, and cause mental, physical and emotional strain on the person and the family. Stop the harassment by retaining our law firm. Once you retain our firm, the harassing phone calls and the stress will stop. When we file a petition for your Chapter 7 bankruptcy or Chapter 13 bankruptcy, all creditor harassment must stop.
- Utilities Shut-off
If you are behind on your utility bills, the protection of bankruptcy can prevent utility companies from shutting off your power and water. Bankruptcy may also discharge your unpaid, due utility bills and other debts to give you a clean start with your finances. The law firm of Stamps & Stamps, Attorneys at Law, can step in to prevent the hardships and indignity of utility shut-off. Even if your utilities have already been cut, our experienced bankruptcy lawyer can help get service restored.
- Credit Card Debt
Bankruptcy can eliminate your unsecured debts, including credit cards and retailer charge cards. You may qualify for a Chapter 7 discharge of debts to start fresh or for relief from creditor harassment through Chapter 13 repayment. The law firm of Stamps & Stamps, Attorneys at Law, can determine if bankruptcy is your best option to get out of debt. If you relied on credit cards after a job loss, divorce, health problems or other hardship, you are not alone. With easy credit at high interest rates, credit card balances can quickly balloon out of control. Attorney Eric Stamps can determine if you are eligible to discharge your consumer debt from credit cards and charge cards.
- Medical Bills
A serious health crisis not covered by insurance can rapidly chalk up tens or even hundreds of thousands of dollars in medical bills. If you are deep in debt because of an accident or serious illness in the family, bankruptcy may allow you to get out from under the impossible burden. The Dayton law firm of Stamps & Stamps, Attorneys at Law, has helped Ohio families discharge medical debt through Chapter 7 bankruptcy or spread the debts over time through a Chapter 13 repayment plan. Both of these options provide immediate relief from creditor harassment and creditor actions such as foreclosure or repossession.
- Student Loan Discharge
Federally guaranteed student loans are nearly impossible to discharge. Even private student loans are no longer dischargeable under changes in the bankruptcy law. The only way that college loans can be forgiven is by proving that the debt creates an undue burden. The hardship standard is intentionally set very high so that few people qualify. It usually requires a catastrophic event that disables the debtor from working. While you cannot escape student loans, Chapter 7 bankruptcy does discharge credit card debts, medical bills, utility bills, judgments and even certain taxes. If you took out large student loans but have no other debts, bankruptcy won't help. However, if you have substantial unsecured debts such as those listed above, bankruptcy may eliminate those debts and free up money to pay off your college loans.
- Tax Debts
Can bankruptcy discharge your tax debts? The cautious answer is no. In general, you will still owe the IRS whether or not you file for bankruptcy. The full answer is more complicated. Some back taxes can be discharged, if all the right criteria are met. Only an experienced bankruptcy lawyer can determine if your situation qualifies. The law firm of Stamps & Stamps, Attorneys at Law, in Dayton, Ohio, provides the focused representation in bankruptcy law to discharge any eligible taxes and take full advantage of your bankruptcy filing to maximize debt relief and asset protection.
