Among the many forms of bankruptcy defined in the U. S. Bankruptcy Code, Chapter 7 is the most common type chosen by individuals, typically those who have few assets, unsecured and credit card debt. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) changed the rules for filing for bankruptcy protection. Previously anyone could file for a Chapter 7 bankruptcy. However, under the new code, your income now determines whether or not you can file.
- Chapter 13 Bankruptcy
For people who are struggling with secured debt but have a stable source of income and do not want to lose their property, Chapter 13 bankruptcy usually offers a better solution than Chapter 7. Chapter 13 allows individuals to reorganize their debt and devise a court-supervised repayment plan based on a three- or five-year period. While a sole proprietor or small business owner assigns personal liability through a Chapter 13 filing, in order for a business to reorganize and file for bankruptcy, a Chapter 11 would be used, not Chapter 13.
- Chapter 11 Bankruptcy
Generally used by businesses but also open to individuals, Chapter 11 offers more flexibility than any other type of bankruptcy and involves reorganization of debt so a business can stay in operation. Unlike Chapter 13 bankruptcy, Chapter 11 has no restriction on the amount of debt involved but can be beneficial in cases of low debt. Sole proprietorship, unincorporated businesses, partnerships and corporations all frequently use Chapter 11.
