Law Firm Overview Free Consultation

The Talaska Law Firm, established in 1998 by Robert J. Talaska, has helped many children and their families who are victims of medical malpractice by collecting millions of dollars from negligent doctors, hospitals and other healthcare professionals responsible for birth injuries. Nationally recognized for its expertise with birth injury cases, the firm has represented clients throughout Texas and in states nationwide.

Medical mistakes happen every day during childbirth. The unfortunate outcome leaves parents with concerns not only about the present but, perhaps more importantly, about their child’s future. Frequently, parents face the need for a child’s ongoing medical care, which burdens them with exorbitant medical costs. In severe cases, assisted care becomes a lifelong endeavor. The attorneys at the Talaska Law Firm have helped many children and their families who are victims of medical malpractice by collecting millions of dollars from negligent doctors, hospitals and other healthcare professionals responsible for birth injuries.

The firm consists of Mr. Talaska, along with his team of experienced attorneys and staff, who concentrate their practice on legal services for parents whose children are victims of medical malpractice. At the Talaska Law Firm in Houston, our attorneys seek compensation to provide for the necessary medical and attendant care children injured at birth may require for the rest of their lives. Our attorneys also pursue compensation for mental anguish, pain and suffering, including impairment and disfigurement.

Practice Areas

Additional Practice Areas: Cerebral Palsy, Brachial Plexus, Birth Defects, Pediatric Malpractice, Erb's Palsy

Practice Areas Description

- Personal Injury

At the Talaska Law Firm in Houston, our nationally recognized attorneys are exceptionally qualified with more than fifty years of collective experience in personal injury law. While personal injury is a broad area of law, our firm concentrates on medical malpractice cases related to birth injury, birth trauma and birth defects.

- Medical Malpractice

Because we focus our practice primarily on birth-related injuries, we limit our adult medical malpractice work to serious and catastrophic claims, including brain or spinal cord injury, amputation or loss of limb, and wrongful death. Attorneys Ted Skarbowski and Tim Culberson have extensive experience handling a broad range of adult medical malpractice claims, including cases that involve: surgical error; failure to diagnose or misdiagnosis; failure to provide proper or adequate care; and prescription or pharmaceutical error leading to serious injury or death.

- Birth Injuries

The firm’s dedicated medical malpractice attorneys and their support staff, have successfully represented families in a broad scope of birth injury cases including those arising from: lack of oxygen at critical stages of delivery that causes cerebral palsy; shoulder dystocia causing nerve trauma in the neck and shoulder and resulting in brachial plexus injuries, which is sometimes called Erb’s palsy; severe swelling or bruising of a baby’s head (caput succedaneum); bleeding in the baby’s cranial region, (cephalohematoma, often caused by forceps-related injury); forceps lacerations or bruising; fractures; facial paralysis; VBAC (Vaginal birth after a previous Cesarean section) – Failure to properly advise about the risks of VBAC; amniocentesis complications; failure to treat complications from fetal-maternal hemorrhage; failure to properly manage shoulder dystocia; traumatic use of vacuum extractors; misinterpretation of fetal monitor strips; misinterpreting pregnancy ultrasounds; misdiagnosis of prenatal tests including non-stress tests and biophysical profiles; failure to timely carry out a Cesarean section; failure to properly care for a critically ill newborn; failure to properly incubate a newborn; failure to prevent preterm deliveries; failure to properly arrest preterm labor; failure to timely administer anti-seizure medications, including transverse lie positions and breech deliveries; and failure to properly manage jaundice.

- Pediatric Malpractice

The Talaska Law Firm offers legal services for children and their parents in pediatric malpractice claims, including cases involving: injuries suffered during or as a result of surgery; mismanaged infections; failure to diagnose correctible anatomic problems; and misdiagnosis of illness or injury. Many pediatric malpractice cases our attorneys handle involve emergency room physicians, nurses or other hospital staff. For a variety of reasons, children require different medical treatment than adults. In emergency rooms that do not customarily treat children, doctors and nurses may miss signs or symptoms of certain types of illness or injury. Lab, communication or diagnostic errors can have a more severe impact on the health of a child than on an adult.

- Product Liability

Many of the products that pregnant mothers use or are exposed to on a daily basis from sleeping pills, asthma medications, antibiotics and prescription drugs to household cleaning products, paint and pesticides can have a negative effect on a fetus during gestation. Examples of products on the market today that can lead to permanent birth defects and even death of a fetus include: lead based paints; products containing mercury, lead, arsenic, xylene, chlorine and other chemicals; pesticides; solvents containing toluene; and prescription drugs including Paxil, Prozac, Accutane, and antibiotics, such as tetracyclines, sulfa drugs and ciprofloxacin. If you believe use of dangerous products or exposure to environmental toxins led to the death or serious injury of your infant, you may be entitled to compensation for damages.

- Wrongful Death

When the negligence or carelessness of a doctor, nurse or other healthcare professional causes the death of a child at birth, no amount of compensation can replace the life lost. However, you have the legal right to hold liable parties responsible for their actions. At the Talaska Law Firm in Houston, Texas, our attorneys concentrate our wrongful death representation on cases involving children who have become so badly injured during pregnancy, labor or delivery that they don’t survive. As personal injury attorneys who have many decades of experience assisting families in infant or child wrongful death claims, we deeply understand the anguish and grief that comes with the death of a child. Our attorneys aggressively protect the rights of parents in claims involving the wrongful death of children and are committed to improving overall patient safety and health care by holding negligent parties responsible for the harm they caused.
