Unlawful Possession of Weapons is simply having a gun or weapon without the legal right to do so, such as a firearm that is illegal to own, or a gun that you don't have the necessary permit or Firearms ID card. - Pre-Trial Intervention (PTI) in New Jersey

Pretrial intervention, commonly referred to as PTI, offers first offenders an opportunity to avoid a criminal record. Several hundred of Ms. Breslow's clients have successfully been admitted into PTI. Once an individual has entered PTI, he or she will have to report to probation, complete hours of community service and must comply with other conditions set by the Court for a period of one to three years. Usually, a 12 month term is imposed and upon successful completion case is dismissed and you will not have a criminal record. Expungement is possible six months later.

- Pre-Indictment (PIP) Court

Pre-Indictment Court (PIP) is a court designed to resolve cases in the preliminary stage, before the matter has been presented to the Grand Jury. Depending on the facts of the case and the offer provided by the State, it could be beneficial to resolve your matter in this court. Ms. Breslow is very familiar both the PIP court procedure as well as how to best advice you as to whether you should take an early plea deal. Ms. Breslow has handled numerous cases in PIP court and she will be able to counsel you on how to proceed in PIP. In addition, if appropriate for your case, she will be proactive at getting your matter listed for PIP court.

- Shoplifting

If you are charged with shoplifting it could have serious consequences. If the value of the item is less than $200 you will be charged with a disorderly person’s offense. Disorderly person’s offenses are heard in municipal court within the local municipality where the incident occurred. If a juvenile is charged with the offense, then the matter is brought to the family division of Superior Court where the juvenile resides. If the items taken were in excess of $200, meaning the value of items exceeded $200, then you can be charged with an indictable offense, commonly called a felony. The charge could be Fourth Degree Shoplifting, Third Degree Shoplifting or Second Degree Shoplifting. The penalties can include jail or probation, fines, community service and other court imposed penalties.
