Arizona typically has a 90 day residency requirement before you can file for a divorce.
* Divorce
As an experienced divorce lawyer, Michael Baker can assist you with all aspects of your divorce, including the following:
Divorce planning and preparation prior to a divorce if you are contemplating dissolving your marriage
Filing a divorce petition or responding to divorce or dissolution of marriage papers if you have been served - we can handle a contested divorce or uncontested divorce
* Child Custody and Visitation
There are two types of custody issues that should be addressed: Physical custody (where the child or children will reside) and legal custody (who will be allowed to make decisions on behalf of the child). The courts will always look to what is in the best interest of the child when deciding custody issues. Mr. Baker will work with you to present your case to a judge or negotiate custody and visitation terms on your behalf. Child custody and visitation can be a factor in determining child support also.
Child visitation (also called parenting time) is either agreed to by the parties and memorialized in a parenting schedule or decided by the court. Visitation issues often include birthdays, holidays, summer vacation, special events, and weekends. Mr. Baker prefers to have the parents attempt to work out custody and visitation arrangements because he believes that parents are in a better position to know what is in the best interest of their child. If the parents are able to work out those issues, Mr. Baker will memorialize the agreement in writing. However, if the parents cannot agree, he will zealously advocate on your behalf in court and present the issues to the court concisely, logically, and persuasively on your behalf.
* Spousal and Child Support
Spousal support is often referred to as alimony or spousal maintenance. As a knowledgeable spousal support (alimony) lawyer, Mr. Baker understands the factors considered by Arizona courts in determining whether spousal support should be awarded, and the amount of spousal support that could be awarded. Some of the factors the court may consider include: Duration of the marriage; Relative incomes; Ability to pay; Ability of each party to support themselves; and Length of time in retraining or obtaining gainful employment.
* Relocation of Minors
In Arizona, the relocation of minor laws make these issues clear. If a parent, either the custodial or non-custodial parent, plans to move more than 100 miles away within the state of Arizona or move out of state, he or she must inform the other parent of the intent to relocate at least 60 days in advance. The non-moving parent can then petition the court to prevent the relocation of the minor child or children. The court may allow a parent to move away despite custody arrangements if: The move out of state would not be detrimental to the child/children; The move is not intended to prevent the child from seeing the other parent; Moving allows parent to pursue a new job that would benefit the family; and A new custody, visitation and parenting time arrangement can be reached, when necessary.
* Injunctions Against Harassment or Restraining Order
Typically, if a non-family member is violent, accused of being violent, stalking or accused of stalking or other harassment, often times a restraining order is sought. In the non-family context (two parties that are not related through blood or marriage), this restraining order is often called an "Injunction Against Harassment" and is a court order for one person to stay away or avoid contact with another person.
* Termination of Parental Rights
Termination of parental rights is a very serious matter. We will help walk you through the process if the parent whose rights are being terminated has consented, and will help you put together a case if they have not. In some cases, the request is being made because the child's safety is in jeopardy.
* Adoption
Parents who want to adopt a child from Arizona, out-of-state or another country - as well as step-parents who wish to adopt their step-children - must comply with Arizona adoption laws. Mr. Baker can clearly explain the law concerning adoption, assist you in fully completing all required forms, and provide counsel and advice throughout the entire adoption process. He can also help you secure birth parent consent when necessary in step-parent adoption cases.
* Post Divorce Modifications
Child Support Modifications - As a child support modification attorney, Mr. Baker represents mothers and fathers in child support modification hearings, including requests to increase or decrease the amount of the child support obligation. In order to make a request for a post-divorce or family court modification involving child support, the party making the request must be able to demonstrate a significant and continuing change of circumstances that warrant a child support modification, which may include a significant change in income by either party.
Child Custody Modifications - As a child custody modification attorney, Mr. Baker represents mothers and fathers in child custody modification hearings. In order to make a request for a post-divorce or family court modification involving child custody, the party making the request must be able to demonstrate a significant and continuing change of circumstances that warrant a child custody modification, which may include relocation (especially out of state), child abuse, or child neglect.
Visitation and Parenting Time Modifications - As a visitation and parenting time modification attorney, Mr. Baker represents men and women in visitation and parenting time modification matters. In order to make a request for a post-divorce or family court modification involving visitation and parenting time, the party making the request must be able to demonstrate a significant and continuing change of circumstances that warrant a visitation and parenting time modification, which may include a lack of exercising parenting time by one parent, requests of minor children, or that one party is preventing meaningful parenting time for the other parent.
