She has been certified through Harvard Law School's negotiation program and UC-Hastings Law School in trial advocacy. Ms. Brenner has a master’s degree in psychology and teaches law at a local university. She is a published author and continues to inform and update the public on the law.

- Family Law Mediation

Mediation is the most practical choice for couples to make when facing a divorce if the parties can agree to it. It helps avoid the stress of litigation, loss of time from work and it saves money. A settlement agreement is worked out mainly by the parties themselves with the help of an attorney mediator. Cherie Brenner is not only certified through Harvard Law School's mediation program but has taught graduate students the mediation process.

- Divorce

A divorce is granted on the grounds of "irreconcilable differences." Irreconcilable differences are any grounds the court determines to be substantial reasons for the marriage not to continue. California was also the first state to implement the concept of a "no-fault divorce." In effect, this means that a married person may terminate the marriage even if the other person disagrees. Cherie Brenner and her staff make every effort so their clients have a full and complete understanding of the process before, during and after the divorce.

- Child Custody

Custody is the charge and control of a child, including the right to make all major decisions such as education, religious upbringing, training, health and welfare. Custody usually refers to a combination of physical custody and legal custody. Many factors influence an award of custody and the way a case is presented in court can have a large impact on the result for you and your children. If you are awarded the children as a primary custodial parent, it has far reaching consequences both to you and to their well-being and development. However there are so many different ways to deal with custody it is best to discuss with an attorney all the options and the effects of those choices.

- Child Visitation

The court looks first to grant custody to both parents jointly or to either parent before looking to grant custody to other persons. California however does not currently establish a preference or a presumption for or against joint custody arrangements. Visitation always seems to be a bone of contention in some family disputes. However, there are so many ways of working on a settlement. Ms. Brenner has training and experience in dealing with couples in the mediation and counseling arena and has worked out numerous disputes involving visitation.

- Spousal Support

In California spousal support duration is linked to a transition period from married life to single life. The circumstances vary from person-to-person, but the courts tend to disfavor "lifetime support." The court has a broad discretion in ascertaining the amount of spousal support as well as its duration. Some California counties have adopted a guideline, which suggests the appropriate range of spousal support on a temporary basis. Many counties do not allow the guideline to be the sole indicator of the amount of permanent spousal support. California State law provides that spousal support is determined by a careful review of a number of factors.

- DUI

Driving under the influence of drugs or alcohol are very serious charges which the State Legislator continues to impose tougher sentencing guidelines. The Brenner Law Firm has negotiated and settled hundreds of DUI cases without the driver ever having to appear in court. Ms. Brenner has also won several cases where the district attorney refused to negotiate the case with a reasonable offer.

- Marijuana Possession

California is known for its generally liberal medical marijuana laws, but the police have been known to arrest people who even have medical authorization. Possession of marijuana, less than one ounce, is a misdemeanor under California law. This means that although the charge is relatively minor, it can still become a permanent mark on your record if you are convicted. Attorney Cherie Brenner has been able to negotiate with the District Attorney on several cases to get the misdemeanor charges dismissed.

- Domestic Violence

Due to high profile domestic violence cases, California laws regarding domestic violence have undergone serious changes. Domestic violence charges can be filed as misdemeanor or felonies depending on the allegations, the accused prior record for violence and the injuries, no matter how minor. Our firm handles the following offenses: spousal battery, inflicting corporal injury on current or former spouse or cohabitant, violation of a court, protective or stay away order, elder and dependent adult abuse; and, child abuse.
