- Asset Valuation / Discovery of Hidden Assets
Unfortunately, during the divorce process, it is not uncommon for suspicions and suspicious activities to arise. It is then that a spouse may intentionally shield or hide assets from the other, making the division of assets highly problematic. Oftentimes a spouse will hide money in a secret off-shore bank account to protect his or her assets in case of divorce. A prenuptial agreement, drawn up before the marriage, is supposed to provide protection by identifying the separate property owned by each party before the marriage took place. - Domestic Violence / Restraining Orders
Domestic violence consists of abusive behavior that includes physical actions, such as hitting, biting, throwing objects. It also includes threats of sexual and emotional abuse, controlling, stalking, and intimidation. At the Buncher Law Corporation our attorneys can help you obtain an emergency protective order to protect you against domestic violence or threats of abuse. Paternity is the term by which a father is granted legally enforceable rights and responsibilities to his child. A paternity suit is an action filed in court when two people were never married, but may have a child together. Paternity can be established by presumption, acknowledgment, adoption, or by a court order. The establishment of paternity is important to a child. The child not only benefits emotionally from knowing the identity of his or her father, but there are also legal and economic benefits for the child, such as child support.
- Cohabitation / Common Law Marraige Issues
California does not recognize ‘common law marriages’. It does not matter how long you and your partner have lived together – without a marriage license you are not married in the State of California. However, California law does allow certain rights to the parties in a cohabitation relationship. A cohabitation agreement, either written or oral, can be drawn up to deal with children, financial and property issues. At the Buncher Law Corporation, our attorneys have extensive experience in advising cohabitants of their legal rights. We will take the time to explain the process so you can understand it before we file a civil lawsuit.
- Custody/Support Modifications
It is a common occurrence that the living situation or job situation of a parent will change, or the specific needs of a child will change. Along with this, comes the modification of child custody, child support and visitation. The original divorce agreement was created under specific circumstances, and when these change, so should the agreement. Change in circumstances can cause the court to revisit custody or support requirements. A change can be anything from loss of a job to an increase in salary to the disability of one of the parents.
- Move-Away Orders
Parents who share custody of their children face a difficult dilemma when one parent decides to relocate to another state, taking the child with him or her. This is referred to as a “move-away”. California Family Code Section 7501 states, “A parent entitled to the custody of a child has a right to change the residence of the child, subject to the power of the court to restrain a removal that would prejudice the rights or welfare of the child.” The right of the custodial parent to move away with the child would adversely affect the non-custodial parent’s visitation rights.
