- Child Custody and Visitation

Not too many years ago, courts in Florida and in most other jurisdictions favored the mother in custody proceedings. However, the modern trend is toward shared parenting. Actively involved fathers often get primary custody or, in the very least, 50-50 "rotating" custody. The Law Office of Jeffrey A. - Custody Jurisdiction Issues

When one or both parents relocate across state borders, custody is governed by the federal Uniform Child Custody Jurisdiction and Enforcement Act. The UCCJEA was established to avoid jurisdictional wrangling between states and to prevent parents from "shopping" for a state with favorable laws to have custody established or overturned.

If one parent's circumstances have changed or the child's welfare is in jeopardy, either parent may petition the court for a modification of child custody. These proceedings can get adversarial very quickly. When parents are not living together, the circumstances of their lives can pull them in many different directions. But children have a right to see both of their parents. Moving far away can make that right difficult or impossible to exercise - and courts sometimes agree that it is in the best interests of the child to have relationships with both parents.


- Enforcing Visitation Rights

Unless a parent can show very good cause for denying access (i.e., a threat to the child's safety or welfare), interfering with your rights to visitation is a violation of the custody decree. I can step in to file a contempt of court complaint. The offending parent will have to appear in court and answer to a judge.


- Fathers' Rights and Paternity

You are a father. If you were never married to your child's mother, then you have no legal rights as your child's father until you have established paternity through a legal proceeding. This is true even if you are named on your child's birth certificate and even though you may be raising or have raised your child.


- Modifying Child Support or Alimony

There must be a substantial change in circumstances to merit an increase or decrease. My familiarity with the court's criteria and required documentation works to your benefit in these post-divorce proceedings.


- Enforcing Child Support

Often the payee parent can request that the court enter a purge amount, establishing the threat of jail if the payor parent does not pay up. As a relative or a step-parent of the child you wish to adopt you already have a strong and loving bond with that child. A formal judgment of adoption will give that relationship legal status as well. Once you are recognized as the adoptive child's legal parent you then have the legal right to make or participate in major decisions regarding your child, including decisions on matters such as schooling and medical care. In addition, you will then be listed as your adoptive child's legal parent on his or her birth certificate. You may also give your adoptive child your surname.

Birth parents are not always able to raise their children. When an adoptive parent assumes the role of parent, new families are born, and children receive a chance at a better life.
