- Guardianship LawGuardianships of the person are created to help those people who are incapacitated or vulnerable. In Texas, an incapacitated person is an adult who, because of a physical or mental condition, is substantially unable to provide food, clothing or shelter for himself or herself, to care for the individual's own physical health, or to manage the individual's own financial affairs. At our firm, we give each of our clients the personal attention they need and deserve. We will work with you to help you resolve the guardianship issues in your particular situation. We help clients with several types of guardianship matters, including:
- Special Needs Guardianships
If your child with Down syndrome, autism, a birth defect or other developmental disability has turned 18 or is about to, we can help establish you as legal guardian. This gives you certain rights over their personal and financial affairs and it can include setting up a special needs to preserve assets without disqualifying your adult disabled child from Medicare or Social Security. Successor guardians and transfer of guardianship — Every guardianship should have a back-up plan. If a guardian dies or resigns for health reasons, we can assist in creating a smooth transition when a new guardian takes over the role.
