Law Firm Overview

The Law Office of M. Timothy Porterfield is a sole proprietorship offering legal services in all aspects of North Carolina domestic relations law. He is also a licensed parent coordinator appointed by the Judge who is assigned to the case, and works directly for the Court. The role of a parent coordinator is to assist parties in high conflict cases involving custody.

Tim Porterfield has more than 20 years of legal experience, and has practiced almost exclusively in family law since 1995 in Mecklenburg County. Based in Charlotte, he serves Mecklenburg, Cabarrus, Lincoln and Union counties. His clients are men and women from all walks of life: doctors, business owners, teachers, pilots, computer professionals, nurses, you name it.

He handles all facets of North Carolina matrimonial and family law, but he concentrate in high-conflict custody, alimony and property division cases. Even in these hotly contested disputes, he tries to engage clients toward a mutually acceptable resolution to move the case forward without spending thousands of dollars on legal fees.

Practice Areas

Additional Practice Areas: Property Division, Modifications and enforcement of custody or support

Practice Areas Description

- Divorce

As you may know, getting divorced under North Carolina law is mostly a formality. You can not file for absolute divorce (official dissolution of marriage) unless you have been separated for one year.
If you have a claim for alimony or division of property it is very important that the claim be resolved prior to the granting of the absolute divorce. Failing to file a claim before that date could quite probably result in forfeiting your rights to marital assets or financial support.

- Legal Separation Agreement

n North Carolina, you can not get officially divorced until you have lived apart for a year. The reality is that couples split up and move forward with their lives long before the 12 months are up. In other words, you need experienced legal counsel at the time of separation to protect your interests and your children. The Law Office of M. Timothy Porterfield in Charlotte represents women or men in negotiating separation agreements in anticipation of divorce. I am a skilled trial attorney who has practiced in family law in Mecklenburg County since 1995.

- Marital Property Division

If you have been married for any length of time, you and your spouse may have amassed significant wealth. If you are ending your marriage, you soon realize your assets, debts and finances are intertwined and that the math of going your separate ways is complicated. The Law Office of M. Timothy Porterfield in Charlotte represents women or men in division of marital property, through contested court proceedings or negotiation of separation agreements. I am a skilled trial attorney who has practiced in divorce and family law in Mecklenburg County since 1995.

- Alimony

Post-separation spousal support can be hotly contested, especially when divorcing spouses are already fighting over property or custody of children. Extra-marital affairs during the marriage or new dating partners after separation only add fuel to the fire. At the Law Office of M. Timothy Porterfield, we try to give clients a realistic and strategic perspective on spousal support — whether it applies and how it fits into the bigger picture of asset division and life after divorce.

- Child Custody

Worried about what will happen with your children in divorce? A lot depends on you and the other parent. Can you come to agreement about primary custody and the details of co-parenting? Or will a judge to decide who gets the kids and when? The Law Office of M. Timothy Porterfield in Charlotte represents mothers and fathers in negotiation and litigation of child custody matters. I am an experienced trial lawyer practicing in divorce and family law in Mecklenburg County, as well as Cabarrus and Lincoln counties. My goal is to protect your relationship with your child through a solution that serves your child's best interests.

- Child Support

Child support is based on a formula. If the financial data plugged into the formula is not accurate, the level of child support will not be accurate. There also may be specific considerations in your case that are not addressed in the guidelines. The Law Office of M. Timothy Porterfield in Charlotte represents parents in child support and all related matters of child custody. As your lawyer, my role is to ensure that your child support order is fair and meets the needs of your child. I practice in divorce and family law in Mecklenburg County, as well as Cabarrus and Lincoln counties.

- Divorce Mediation

Under North Carolina law, couples must attend mediation before they can proceed to trial over child custody or marital assets. Some people view mediation as a box to check off so that they can go to court. At the Law Office of M. Timothy Porterfield in Charlotte, we help clients make the most of mandatory mediation, even when it is clear that the custody or property dispute will end up in litigation.

- Enforcement & amp; Contempt Orders

After a divorce, employment can change, the kids grow up and the adults may enter new relationships. Sometimes these changes result in disputes or a mutual agreement to modify the original court order. The Law Office of M. Timothy Porterfield is prepared to protect your interests in contested proceedings for modifications or enforcement of orders relating to child custody, visitation, child support or alimony.

- Domestic Violence

Allegations of domestic violence are taken seriously by the courts in North Carolina, and we take them seriously, too. The Law Office of M. Timothy Porterfield assists victims of domestic violence in securing restraining orders. We also represent those accused of domestic abuse. I have practiced in family law in Mecklenburg County since 1995, and I have seen domestic violence from both sides of the issue. I understand that it is an urgent issue, but one that should be handled sensitively, especially when there are ramifications for child custody and divorce.
