The Law Office of Martin Genet handles all areas of Family Law in south Florida (Dade, Broward, and Palm Beach counties) including, but not limited to, divorce, child support and alimony. Martin Genet, Esq. went to Tulane University School of Law where upon graduating he was admitted to the Florida Bar and spent time working with the Public Defender's Office in Miami and then taking a job as an Assistant Attorney General in Broward County. Mr. Genet then started the Law Office of Martin Genet, PA in April 2010 where the firm focuses on primarily divorce and other family law related issues such as Child Support and Time Sharing (formerly known as Custody).

If you believe that you are entitled to a modification of child support in the state of Florida, then it would be to your benefit to file as soon as possible as modifications are generally only retroactive to the date the modification is filed, and not earlier. This means that in most circumstances the court cannot compensate the parent who files for any time period prior to the date of filing. - Suspension of License
If the Florida Department of Revenue determines that you are behind on your child support, it may initiate an action to suspend your driver's or business license. Most cases involve driver's licenses. However, your business or occupational license can also be suspended (i.e. contractor's, liquor, cosmetology, doctor's, lawyer's licenses, etc.). It can sometimes take weeks and possibly months, to get the suspension lifted (once in place). Even when the Court orders a lifting of the suspension, the DMV is short-handed and may not lift the suspension immediately. The longer you wait, the greater the chance that you will be facing additional costs and time in getting your license reinstated.
- Paternity
There are a variety of reasons why a person may be entitled to a DNA test. The most common scenarios are: To prove that you are not the biological parent of the child and ultimately to show that you do not have an obligation as the child(ren)'s legal parent; and to prove that a child is yours so that you are entitled to visitation, custody, timesharing, etc. If you would like to set up a low-cost consultation to discuss your DNA test and disestablishment options, our firm has year upon years of experience handling such cases.
- Arrears
There are many circumstances where parents have fallen behind in their monthly payments and this can result in a situation where it becomes difficult if not impossible to catch-up. Often times when a parent falls behind in child support the other side files a motion for contempt. There are defenses to such motions and it is important to participate in the proceedings to ensure that your rights are not violated and a fair result is obtained. There are also circumstances where the amount of back child support (arrears) is incorrect and should be recalculated.
- Child Custody
If you are having problems getting to see and spend time with your child(ren) it may be in your best interest to obtain a court order that sets out your rights to see your child(ren) including the days and times in which you are entitled to have/see your child(ren). These problems may be: The other parent or another person who has the child will not allow you any time with your child; and the other parent or another person who has the child chooses when to allow and not allow you access to the child. - Invalid Court Judgments
If your back child support is based upon an invalid Court judgment (i.e., you were never properly served with Court papers, and/or the judgment was entered without your having had the opportunity to appear in Court), all or a portion of the debt can be wiped out if the judgment is set aside. If you think that your child support or other order is invalid it is important to take action immediately as there may be a time limit on your getting the relief you deserve.
