- Patents

A primary focus of our practice relates to the acquisition, maintenance, and protection of domestic and foreign patents. We have experience with patent matters relating to a wide variety of technologies, including the mechanical, medical, electrical, and optical arts. We carefully and expertly guide clients through the patenting process, from the initial conception of an invention, an assessment of patentability, the preparation of an application, to high-quality prosecution of that application. We help clients draft and prosecute patent applications that withstand the most rigorous technical examination. We consider each filings strategic position in your patent portfolio, advice on strategies to secure additional product patent protection, and determine the best application procedure to use.

- Trademarks

We offer a full range of legal services relating to trademarks. Initially, we can advise you as to the availability, strength, and registrability of a trademark. Federal registration, although not required, has significant benefits, including: Providing constructive notice to the public of your claim of ownership of the mark; Creating a legal presumption that you own the mark and have exclusive right to use the mark nationwide on, or in connection with, the goods and/or services listed in the registration; Permitting enforcement of your trademark rights in Federal Court; Serving as a basis to obtain registration in foreign countries; and Allowing you to prevent importation of infringing foreign goods.

We can help you determine if keeping information a trade secret is best for your company. When maintaining information as a trade secret is best, we can help by: developing and implementing corporate trade secret protection programs; identifying trade secrets; preparing employment and other confidentiality agreements; and pre-litigation counseling. Conversely, when the protections of patent law will better meet your needs, we can guide you through that process as well.
