Practice Areas Description
The Law Offices of Basil D. Beck, III, provides quality and experienced legal representation in the following areas:Criminal Defense
- Driving Under the Influence (DUI) or Driving after Imbibing (DAI)
In 2004, Pennsylvania enacted stringent laws for Driving Under the Influence (DUI), which is now referred to as Driving after Imbibing (DAI). Some of the more substantive changes are: (i) lowering the legal limit for alcohol in the system from .10 to .08 percent blood-alcohol; (2) a .08 percent or above blood-alcohol level, at the time of a test, is sufficient evidence for a conviction; (3) adopted zero tolerance for any illegal drugs in your system, including prescription drugs not prescribed to you; (3) stiffer penalties, including more jail time, longer Driver’s License suspensions, and higher fines.
Depending on your driving record and the circumstances surrounding your arrest, hiring an experienced DUI lawyer can increase your chances for avoiding jail and having your license suspended or revoked. Additionally, it may be possible to have the charges against you either reduced or expunged from your record -- saving you a substantial amount of money in increased insurance premiums.
- Assault
Assault charges are not restricted to persons who simply attack other people for little or no reason at all. In domestic disputes, bar fights, and incidents of road rage, a person who is not even responsible for starting a fight or initiating a confrontation can be charged with assault. Since police often arrive after a fight has started or ended, angry spouses, girlfriends, or prejudiced onlookers can wrongly convince police to arrest you, even though you were simply defending yourself. At the Law Office of Basil D. Beck, I meticulously review police and eyewitness statements, working with private investigators if necessary to determine what other people present saw when bolstering my client's version of events. The Law Offices of Basil D. Beck, III, advise and defend people accused of committing assault involving the following situations: Bar fights, Road rage, Sporting events, Domestic disputes, Parking lot disagreements, and Disputes between neighbors.
- Domestic Violence
When spouses or live-in couples have an argument, it's not uncommon for a wife or girlfriend to call police in order to have an unwelcome boyfriend or spouse removed from the home. To convince police to act, an angry spouse or girlfriend may claim she was hit or threatened. Interested in diffusing potentially volatile situations, police rarely investigate assault allegations but simply remove the alleged abuser from the premises, only to have a judge sort out the matter later.
- Battery
When evidence and guilt is not in question, extenuating circumstances may convince the court to either reduce the charges against you or the sentence you face. As your assault lawyer, Mr. Beck works with prosecutors in exploring alternative sentencing options when a plea of "guilty" may be in your best interest. In certain cases where provocation, a medical condition, or alcohol is involved, it may be possible to avoid jail or a heavy fine in exchange for a promise to get counseling, provide community service, and agree to probation.
- Theft
Most arrests and prosecutions involving theft depend on eyewitness testimony, fingerprints, and security camera video footage when shoplifting or stealing is involved. However, despite what police might tell you at the time of your arrest, the evidence involved can be questionable at best. Eyewitnesses often can't be sure what they see at a distance or at night, video footage can be grainy or indistinct, and racial profiling can play a role in including or excluding suspects. The law office of criminal defense attorney Basil D. Beck represents clients charged with the following theft-related crimes: Stealing, Shoplifting, Bank robbery, Identify theft, Armed robbery, Purse snatching, Credit card theft, and Breaking and entering.
- Probation and Parole
Loss of a job, failing a drug test, possessing a firearm, or being seen in the company of known felons can quickly result in a violation of the terms of your parole or probation. Failure to report a violation to your parole officer can result in re-arrest and an appearance before a judge who may decide to overturn your parole or probation. Since parole officers are often skeptical of the excuses they hear from those they supervise, it's unlikely they will serve as a strong advocate for you in court. Violations of the terms of your probation or parole can involve any number of the following kinds of factors: Failure to notify parole officer if you move; Unsupervised contact with your children; Failure to tell parole officer of new job; Keeping company with known felons; Patronizing a bar or liquor store; Failing a mandatory drug test; Committing a new crime; Purchase of a firearm; Loss of employment; Use of a computer.
- Drug Charges
The "war on drugs" has turned into a war on peoples' Constitutional rights. Police, prosecutors, and especially federal agents, now have more investigative reach than ever before. Authorities can now conduct wiretaps, electronic surveillance, review a suspect's computer activity, and monitor banking activity if a court is convinced enough evidence exists to warrant doing so. At the Law Office of Basil D. Beck, we aggressively defend our client's rights by putting the police and investigators on the defensive. We challenge the validity of search warrants, how they're presented to the court to justify their issuance, "knock and talk" enterings of houses and apartments, car stops, and personal searches on the street. Mr. Beck's office defends people charged with the following kinds of criminal drug offenses: Drug Possession, and Drug Trafficking.
- Driver's License Suspension
There are two ways in which your driver’s license can be suspended or revoked: (i) By a judge’s order in a court of law; (2) Administratively by the Pennsylvania Department of Transportation (PENNDOT). If you have received a letter from PENNDOT you need to contact an attorney as soon as possible because you only have 30 days from the day of mailing to respond.
- Traffic Violations
Not only are traffic tickets irritating, they are also costly and inconvenient. More troubling even than the heavy fines that can result, however, are the points that will be assigned to your driving record. Too many and your driver’s license could be suspended. Worse, you’ll pay even more when your insurance rates go up. It is worth your time to contact an attorney and find out what your options are.
When you pay a traffic ticket instead of going to court, you’re admitting you’re guilty. Even if you’re caught dead to rights, you should consider taking the time and effort to contest your ticket because pleading guilty means points will be assigned to your license and the insurance consequences can last for years.
- Underage Drinking
When a minor is cited for underage drinking, the Pennsylvania Department of Transportation (PENNDOT) will issue a 90 day license suspension. A second offense will result in a 1 year suspension. These are administrative actions and are completely separate from the juvenile court proceedings. Even if your child complies with every order and requirement of the court, a drivers' license suspension will still be issued.
Personal Injury
- Motor Vehicle Accidents
According to the National Highway Traffic Safety Administration, an automobile accident occurs every ten seconds in the United States. In fact, motor vehicle injuries constitute 99% of non-fatal transportation injuries and 94% of transportation deaths. For over a decade, Mr. Beck has been helping individuals who have suffered a personal injury due to car crashes, truck wrecks, and motorcycle accidents.
In many cases, individuals who have suffered injuries such as brain or spinal cord injuries or other losses have difficulty securing compensation from uninsured and underinsured motorists. In other situations, such as commercial vehicle collisions, it may be difficult to collect from the driver’s employer or insurance company without help.
