If you are interested in eliminating—or discharging—unsecured debts such as credit card debt, medical bills or deficiency balances due to auto repossession, Chapter 7 may be the right option for you.

All of your non-exempt property is converted into cash by a bankruptcy trustee who then distributes it to your creditors. Within four months you should receive a discharge of all dischargeable debts.

Chapter 7 may be the best choice if you have a lot of debt but few assets because it allows you to start over relatively quickly.

- Chapter 13

Chapter 13 bankruptcy may be the right option if you have non-exempt property you would like to keep and a reliable income you can use to pay your daily expenses while making payments on your debt. This is an excellent way to protect your car from repossession and your home from foreclosure. Filing for Chapter 13 stops all repossession and collection efforts against you—as long as you make your payments on time and, in the case of your automobile, keep your insurance current. If your home is in threat of foreclosure, your Chapter 13 repayment plan should enable you to catch up on your mortgage payments within 36 to 60 months.

Filing for Chapter 13 bankruptcy allows you to create a three- to five-year debt repayment plan based on your income instead of your assets. Your debts are consolidated into a single payment that you make to a Chapter 13 trustee who, in turn, disburses payments to your creditors. All of the payments are made according to your court-approved and legally binding Chapter 13 plan.
