For over 20 years, Mr. Boston's law practice has been devoted to representing individuals who have been hurt by the negligence of others. Before starting his law firm, he was an insurance defense attorney in an Atlanta law firm, defending those accused of negligence. As a result, he has a strong understanding of how insurance companies operate.

He is a graduate of the University of Georgia School of Law. He is a former insurance defense attorney with a major insurance company; a certified mediator and arbitrator; and has represented personal injury clients for over 20 years. Practice Areas Description

The Law Offices of J. Phillip Boston offers legal services on the following areas of practice:

- Personal Injury

In personal injury actions, the normal time frame is two years from the day of the incident. There are numerous exceptions to these timeframes, such as lawsuits over damage to reputation. When there's an injury to a minor, the minor normally has two years from the date they turn 18-years-old to file a lawsuit. Some injuries have a shorter time frame in which to file suit. (The typical statute of limitations for a property damage claim is four years). If you fail to file a lawsuit within the applicable statute of limitations, your lawsuit will be "thrown out of court" by the court, and you will not later be able to file a lawsuit. If you have a claim against a city or county or the state or federal government, there are notification rules which must be followed prior to filing a lawsuit.

- Auto Injury Claims

If you are injured in a vehicle accident, under no circumstances should you allow the other driver to talk you into not calling law-enforcement. As long as you obtain the other driver's insurance and contact information, failing to report the accident to authorities may not be fatal to your claim, but is certainly highly detrimental. Although you are injured, and the other driver is at fault, and you may be angry at him, it will help your case if you are calm, show concern for their injury status, and do not berate or argue with the other driver. (Your behavior could come out at trial, and might adversely effect a jury. Often the other driver's bad behavior is used against them).

- Tractor Trailer Collisions

Given their size, trucks, of course, are more likely to cause very serious injuries. While a client's mental and physical pain and suffering, and medical expenses and lost income, must be presented thoroughly, the value of a truck case may be increased significantly by discovering bad conduct on the part of the trucker or trucking company. Truck drivers and trucking companies are highly regulated by state and federal regulation. It is very rare to find that a truck driver and his company were not in violation of numerous safety regulations at the time of a collision. Often these regulations will subject the trucker and trucking company to punitive (punishment) damages.

- Premises Injury

When injured on the property of another, it is essential that you do not give a recorded statement. Proving negligence of the owner or manager of property is difficult. An adjuster may lead you to make incorrect assumptions that will destroy your claim. An attorney will prepare you for a statement. (You will certainly be told to tell the truth about what happened). The fact of injury, or even that some substance was on the floor or that there was a defect in the property, does not prove that the owner or manager was at fault. As a general rule, you must prove that their negligence caused the defect, or that they knew of the defect (normally a very difficult matter to prove), and didn't take reasonable efforts to make the area safe.

- Wrongful Death

Many factors are related to the value of a death claim, as in all personal injury claims. While unfortunate, I have found that jurors will often consider who would be receiving any money they might award. For example, a distant relative pursuing a claim will rarely obtain the same judgment as a spouse, or, particularly, a young spouse with children. As in all claims, a large truck company or a corporate defendant normally will increase the value of a claim. When there is not a corporate/business entity to sue, jurors are often fearful that a very large award would financially devastate the defendant. (Generally, jurors cannot be told whether insurance coverage applies, or in what amount).

- Dog Bites

Dog bite injuries can be very severe, and life-threatening. If you or a family member have been attacked by a dog, I recommend you follow the general advice I have made on this Web site concerning any personal injury claim, including getting immediate medical attention and not giving a recorded statement. After a dog attack, obtain as much information from the owner and any eyewitness as possible. Often, dog owners will continue to ignore leash laws after the attack. As unobtrusively as possible, seek to video the continuing violations, as well as the barking and growling dog.

- Uncontested Divorce

An uncontested divorce means that both parties have reached an agreement on all issues, including child support and visitation, the division of property, alimony amounts (if any), and all other issues, and my client's spouse is willing to execute all paperwork, including signing an Acknowledgement Of Service, so that Sheriff's service will not be necessary. If there is any significant dispute at the outset, you should not retain me to represent you. However, I will offer you general advice on how to approach your spouse, in the hopes all matters can be resolved. If you have allegations of domestic violence or child abuse, you should consult with an attorney with a practice largely limited to domestic relations.
