- Speeding

Whether you were simply passing through the Empire State or you are a resident of New York, receiving a speeding ticket is never fun. Not only can it be expensive, but it is often a hassle to take care of and it can harm your driving privileges. n addition to your legal troubles with the Department of Motor Vehicles (DMV) after a speeding violation conviction, you are likely to face increased insurance premiums that can add up to quite a large sum over several years.

- Reckless Driving

In some states, excessive speed alone can constitute reckless driving. Not so in New York. According to Section 1212 of the New York Vehicle and Traffic Law, "Reckless driving shall mean driving ... in a manner which unreasonably interferes with the free and proper use of the public highway, or unreasonably endangers users of the public highway." If a driver has been cited for driving at a high rate of speed — perhaps more than 100 mph — it is important to note that New York courts have held that speeding alone is not enough for a reckless driving charge. Rather, the police officer must report some means of interfering with others using the roads or creating an unreasonable danger — such as driving while intoxicated or driving erratically.

- Driving Without a License

If you have been issued a traffic citation for driving without a license or another traffic violation, you may be inclined to handle the matter yourself, thinking it's cheaper and easier to just plead guilty, pay the fine and move forward with your life. Before you make a decision that could adversely affect your car insurance and driving privileges, speak with an attorney who can advise you of your rights. An experienced traffic defense attorney may be able to seek a plea agreement that results in a plea of not guilty or a plea to a lesser offense that will have less serious penalties. - Aggravated Unlicensed Operation

New York state Vehicle and Traffic Law defines "aggravated unlicensed operation [of a motor vehicle] in the third degree" as follows: "when [a] person operates a motor vehicle upon a public highway while knowing or having reason to know that such person's license or privilege of operating such motor vehicle in this state or privilege of obtaining a license to operate such motor vehicle issued by the commissioner is suspended, revoked or otherwise withdrawn by the commissioner." Receive another speeding ticket within months of your last ticket? Been charged with a second DWI offense in less than 10 years? The more traffic offenses you are charged with in New York, the greater the potential consequences. If you're stopped for speeding a second time in a year and a half, your fines could double. Plus, each conviction for speeding, reckless driving, failure to obey a traffic signal or any other moving violation adds points to your NY driving record. Once you accumulate six points in 18 months, you will be assessed a driver responsibility assessment — which results in an annual fine for three years. If you accumulate 11 points in 18 months, the NY Department of Motor Vehicles (DMV) will suspend your license.

- Out-of-State Traffic Violations

Maybe you were driving through upstate New York on vacation. Perhaps you were just passing through the state to visit family or friends on the Eastern Seaboard. No matter what the reason for your journey, the last thing you want to deal with is a New York speeding ticket or traffic violation when you are from another state or country, such as Canada.
