* FELA / Railroad Injuries

In 1908, Congress passed the Federal Employers’ Liability Act (FELA) in response to the high number of railroad deaths in the late 1800s and early 1900s. Under FELA, railroad workers who are not covered by regular workers’ compensation laws are able to sue companies over their injury claims. FELA allows monetary payouts for pain and suffering decided by juries based on comparative negligence rather than a pre-determined benefits schedule under workers’ compensation.

* Personal Water Craft / Jet-Ski Injuries

Personal watercrafts (jet skis, Ski-Doos, etc.) have become increasingly popular over the past 10 years. In Minnesota and Wisconsin, thrill-seekers are able to savor the exhilarating fun on the area's many beautiful lakes. Unfortunately, the same qualities that make personal watercrafts enjoyable can also make them dangerous. Inexperienced riders on fast and maneuverable machines often end up with serious and sometimes fatal injuries. Although fewer than 10% of boats used in Minnesota and Wisconsin are personal watercrafts, they account for nearly half of all boat collision accidents. According to the U.S. Coast Guard, a jet skier is almost 10 times more likely to be injured than a passenger on a boat.

Simply put, the manufacturer of a product has a fundamental obligation to design, manufacture, and give instruction on continued care of a product to keep it reasonably safe to use. In certain cases, auto manufacturers are held at least partially liable for auto accidents where the defect did not actually cause the accident, but rather did not function properly in the case of an accident.
