Marital property is property obtained during the marriage. It is considered to be owned by both spouses. There are certain exceptions where one spouse owns property obtained during the marriage, including personal gifts and inheritances. Today in Georgia, marital property is subject to equitable division. Instead of splitting property 50/50, the court will make a determination of what is fair by considering many factors such as: The length of the marriage; Assets owned separately by each spouse; Future financial needs of each spouse; The earning potential of each spouse; Financial dependency of one spouse on another; Prenuptial agreements; and, The conduct of the parties during the marriage.
