Law Firm Overview
Free Consultation
The Slomka Law Firm lawyers, team of experienced and well-trained staff, and the outside consultants whom we work with are all dedicated to helping our clients find financial freedom. In many cases this is through bankruptcy, and often, we are able to find alternatives to bankruptcy for our clients like debt negotiation or loan refinancing and modifications.
Although the world puts a stigma on people who need to seek debt relief in the form of bankruptcy, the fact is, the smartest, most organized people in the world could be hit with sudden medical emergency, income loss or family tragedy that renders them suddenly thousands, even hundreds of thousands of dollars in debt.
Serious debt has nothing to do with mistakes in most cases. More often than not, our clients are facing bankruptcy because of circumstances outside of their control and because of the difficult economic times we are facing in our country. The important thing is not to worry about who is to blame, but to find a way to hit the reset button on your finances and get a fresh start.
If you are facing insurmountable debt, you are not alone, especially with the current state of our economy. Fortunately, our legal system offers seriously indebted citizens a fresh start — the chance to hit the reset button and get a second chance for financial freedom.
Practice Areas
Practice Areas Description
- Chapter 7 BankruptcyWhile many people love the idea of getting a fresh start and the instant stop to creditor harassment, they worry about losing their assets as part of the bankruptcy process. This is most likely something you do not need to worry about. In most cases, you will be able to save your house and save your car. However, if you have a house or car that is in arrears, we will not be able to help you hold on to it as part of a Chapter 7 bankruptcy.
- Chapter 13 Bankruptcy
Chapter 13 bankruptcy is not a handout and is nothing to be ashamed of. It is an opportunity for you to get your financial house in order and pay off your debt. The Chapter 13 payment plan lasts for a period between three and five years, and the payments have zero interest. You could think of it as making a zero interest loan to yourself for five years, after which your debts will be wiped away. In order for Chapter 13 bankruptcy to work, you will have to have steady income that allows you to make your payments. This is ideal for people who have income to make a mortgage payment, but have fallen behind due to unforeseen circumstances.
- Foreclosure Defense
If the recent economic downturn and crash of the housing market has put you in a difficult situation with your mortgage, it may feel like you have no options beyond letting your home go into foreclosure, but you do. By filing for bankruptcy, you may be able to save your house while ridding yourself of other debts as well. In some cases we can even help you eliminate a second or third mortgage.
- Repossession Defense
At The Slomka Law Firm, P.C., we can help you save your car by using a Chapter 13 debt consolidation plan. We can stop the phone calls from creditors and stop repossession from happening. The main thing you need to know is that as soon as you file for bankruptcy, whether it is Chapter 7 or Chapter 13, the repo man will have to stop harassing you. Also, if your car has already been repossessed, act quickly and we can get it back as part of your bankruptcy filing.
- Creditor Harassment
Creditor harassment: This is one of the worst parts of being in debt. Creditors and their collections agents are exuberant, tireless in their collections efforts. You probably have the voice mail messages and U.S. mail collection to vouch for this. There are many ways that we can help you stop creditor harassment, including: automatic stays, chapter 7 and 13 bankruptcy, debt negotiation or loan refinancing and modification.
- Wage Garnishment
If you have received a letter regarding a lawsuit from a creditor, there is no time to waste. If you don't deal with this right away, you will probably see another letter very soon saying your creditor can take money out of your paychecks to satisfy the debt. This is called "wage garnishment," and it is something that no one wants to experience. Especially if you are indebted to other creditors, wage garnishments can be catastrophic. Our experienced Atlanta debt-relief attorneys can help you stop wage garnishments and find the solutions you need to hit the reset button on your finances and get a fresh start.
- Tax Debt
Of all the different types of debts, tax debt and tax liens are among the most difficult to deal with. In most scenarios, tax liens mean nothing but trouble. But there are some options that might help, including: chapter 7 bankruptcy, chapter 13 bankruptcy and debt negotiations. In some cases, debt negotiation can be a good bankruptcy alternative for your tax debts. There is no way the government will forgive this debt outright, but through skilled negotiation, we can help you get a better deal with your outstanding tax debts.
- Credit Card Debt Relief
here are a number of ways you can eliminate credit card debt, an unsecured debt, through bankruptcy. If you can pass the bankruptcy means test, your credit card debt can be quickly eliminated through Chapter 7 bankruptcy. If you do not qualify for Chapter 7 due to the means test or because you recently filed for bankruptcy under Chapter 7, you can pay off your credit card debt over three to five years as part of a Chapter 13 debt consolidation plan. For other clients, we can use direct negotiation with your creditors to reduce the debt through settlement.
- Medical Debt Relief
Even if you have a good health insurance policy, a serious medical problem can still rack up large amounts of medical bills. As the months and treatments go by, it can become very difficult, even impossible, for you to keep up. If you are struggling with medical debt, you may be able to benefit by filing for bankruptcy. Medical debt, like credit card debt, is unsecured debt that can be easily wiped away by filing for Chapter 7 bankruptcy. However, if filing under Chapter 7 is not in your best interests, you can also include your medical debt in a Chapter 13 debt consolidation which allows you to pay some or all of your balance over time with no interest or penalties.
