Practice Areas Description
Our practice includes:- Defective or Unsafe Products
Paul has personally handled multiple product liability cases, ranging from defective consumer products such as a child’s crib causing death or a dog leash causing blindness all the way to defective automobiles causing paralysis and industrial products causing severe burns. These defective product cases are extremely time consuming and very costly. Many times they involve complex engineering, design and warning issues as well as complex regulations and/or standards. In short, these cases are not for all lawyers.
- Child Injury & Abuse
The injury to a child can be devastating to a family. Depending on the severity of the injury to the child, the family can be faced with unexpected and catastrophic medical bills, required time off from work for the parents to stay with the child until he or she recovers to an extent that he/she can return to school or non-skilled supervision. The family can also be faced with a mountain of future medical expenses and treatment and if the child has a handicap as a result of the injury, costs associated with modifications to the home or vehicle. Again, it pays to have an attorney who has experience in dealing with these types of cases. Mr. Thomson has successfully handled these types of cases.
- Dog Attacks & Bites
Each year hundreds of children and adults are attacked or bitten by vicious dogs. Some of these animals have bitten before, some have not and some are breeds that have a reputation for aggressiveness, while the dog itself may have never bitten before. In my opinion, the laws of Virginia are inadequate to fully protect the rights of victims of dog bites. In certain circumstances, the dog owner and/or caregiver may be able to escape liability, leaving the victim burdened with medical bills and horrible disfiguring injuries. The outcomes of these cases can be determined by various factors. Mr. Thomson can help.
- Automobile, Tractor Trailer, Motorcycle, & Pedestrian Accidents
Automobile accidents come in different shapes and sizes; they can involve passenger cars and trucks or motorcycles or tractor trailers. Pedestrians can also be the victim of a negligent car, truck or commercial vehicle driver. The injuries to victims of those crashes can range from soft tissue or whiplash type injuries, all the way to broken bones, traumatic brain injuries, paralysis and even death. Paul handles only those cases involving serious injuries, broken bones, brain injury, paralysis, disfigurement or scarring from cuts or burns and death. As was emphasized earlier, Paul devotes his practice to a few select cases. Your case will not be assigned to a paralegal or young associate with Paul never to be heard from again. Your case will personally be handled by Paul. From the start of the case to trial, Paul will be by your side.
- Drunk Driving Injuries
As you might imagine, these cases are vigorously fought, and this is not easy to prove. Just as the drunk driver hires skillful counsel to try and get out of or beat the DUI conviction, the same is true for the civil lawsuit that is levied against them. A thorough and timely investigation is necessary. No matter who you hire, it is important to make sure that the attorney you hire has experience in successfully dealing with DUI civil cases. Mr. Thomson has successfully resolved cases for victims of drunk drivers. These cases are complex and the outcome can be determined by various factors.
- Wrongful Death
Wrongful death actions can be brought on behalf of families that have lost loved ones due to any number of reasons including, but not limited to medical malpractice or negligence, automobile accidents, defective or dangerous products, workplace injuries, intentional acts of persons etc. An evaluation of your case by a qualified attorney will determine if a viable action exists, as well as, who the proper parties to the lawsuit will be. Time is of the essence, as this investigation may require some time, due to complexities of the corporate set up, and/or the need to locate witnesses. Let Mr. Thompson help.
- Asbestos Disease
Among the many threats construction workers face on a daily basis, exposure to asbestos is perhaps the most unforgiving. Construction companies are required by law to comply with safeguards to protect construction workers from exposure to asbestos. But despite ample warnings from the government and verdicts in the courts that issue steep penalties for non-compliance with asbestos standards, many construction companies, faced with deadlines, tight budgets, or a simple ignorance about or disregard for the dangers of asbestos, will sometimes require construction workers to work in areas where asbestos exposure is extremely likely. If you have worked in construction or the building trades industry or the naval shipyards for many years and you believe you were exposed to asbestos during that time, or if you have contracted an asbestos-related illness from work you did prior to 1980, you have rights that experienced attorneys can help you exercise to obtain a settlement or verdict.
- Medical Malpractice
Cases involving medical malpractice or medical negligence are extremely difficult. These cases demand specialized knowledge by the attorney, expensive medical experts, and add to that, the medical provider usually wins 3 out of 4 cases that go to trial. If you believe that you have been injured by the malpractice or negligence of a doctor, hospital, nurse or other health care provider, then you need to make sure that you have hired an attorney that has all of the above attributes—specialized knowledge and experience in dealing with complex medical issues, access to medical experts, the funds to hire these medical experts, the ability to fund a case all the way to trial, and the ability to try the case if it does not settle. Paul Thomson has these abilities. Paul has handled medical negligence or malpractice actions in cases involving the negligent conduct of doctors, nurses and hospitals.
- Nursing Home Abuse or Neglect
Having to place a loved one in a nursing home or assisted living facility is one of the most difficult choices you may ever have to make. The ability of the family to provide the appropriate care, supervision and feeding of elderly relatives is a monumental task, and choosing a care center to provide services usually cannot be avoided. Sadly, many of these facilities are understaffed which can result in medication errors, falls, pressure ulcers or bedsores, physical and verbal assaults, poor feeding and even sexual abuse. These cases can be complex, time consuming, expensive and are vigorously defended. Mr. Thomson has successfully handled cases involving residents of assisted living facilities and nursing homes.
- Workplace Injuries & Construction Accidents
Many people are injured on the job every day. Some are injured in car wrecks on the job, some are injured by machines or equipment they use on the job, some are injured by other workers on the jobsite who are not fellow employees. Most of these people file for worker’s compensation benefits and leave it at that. However, in Virginia and West Virginia, you may be able to file what is called a third party action against the responsible party. The law is complex and to a great extent, actions taken in one case can have an adverse effect on the other case. This is why it pays to have a lawyer who has experience handling third party actions. Mr. Thomson has experience successfully handling third party actions involving defective products, and car accidents and injuries caused by other workers who are not fellow employees.
- Premises Liability
Each year hundreds of people are injured due to a property owner or renter’s negligence. These cases range from an owner or tenant who has conducted shoddy repairs, or failed to conduct repairs at all, to owners or tenants who are aware of dangerous conditions and fail to remedy them, to falling merchandise at a store. The law in these areas can be difficult. To complicate things it can difficult to find insurance, as in many cases, the law holds the tenant responsible and lets the landowner off the hook. With cases involving large retail store chains, there can be several corporations set up to run different aspects of the business, making it quite difficult to determine the correct entity to file suit against. Again, it pays to have an attorney who has experience in dealing with these types of cases. Mr. Thomson has successfully handled these types of cases.
