Law Firm Overview

The Venardi Elam Firm, LLP was formed to give individuals the same vigorous, competent, and tenacious representation that is normally reserved for large companies that can afford to pay the best lawyers. We call this the Gold Standard. After years of representing Fortune 500 companies, Larry Elam and Mark Venardi formed the firm. Individuals or small companies deserve the Gold Standard representation more than anyone else, and we are determined to provide it to you on a contingency fee basis if you have: (1) suffered serious and catastrophic personal injuries; (2) been treated unfairly by your employer; (3) been mistreated by your insurers; or (4) been taken advantage of by another business.

Our firm is backed by over 20 years of expertise gained as partners for one of the most powerful and sought-after law firms in the country. Your case will be handled and personally supervised from start to finish by Partner Larry Elam and/or Partner Mark Venardi, both AV Rated. Though we will appropriately staff your case, the partner handling your case will be your primary contact - not a rotating associate or staff person.

The Venardi Elam Firm primarily handles cases on a contingency fee basis, which we will be happy to discuss with you. In such cases, we do not collect a fee unless we recover damages. In commercial disputes, we often customize fee agreements, which may be part contingency, or a contingency fee arrangement which may require that the client pay only the costs in advance, and then we do not collect a fee unless we recover damages. We are confident in assisting you with legal matters regarding Seaway Accidents, Oakland Personal Injury, Wrongful Death, Auto Accidents and more.

Practice Areas Description

The Venardi Elam Firm represents individuals in the following practice areas:

- Personal Injury

The Venardi Elam Firm represents individuals who have suffered serious and catastrophic personal injuries because of the careless or intentional misconduct of another. Victims of personal injury and families of wrongful death victims are entitled to financial compensation for their medical and property expenses, loss of income, incidental costs caused by the accident, pain and suffering, and additional damages to cover future medical expenses, or other issues.

Most catastrophic personal injuries include physical, emotional, and financial hardships. The Venardi Elam Firm strives to ease these burdens so victims and their families can concentrate on healing. Any case in which one person is hurt by another person's negligent or wrongful action (or inaction) may be considered personal injury. The most common types of personal injury cases are: Amputation; Auto Accidents; Animal & Dog Bites; Birth Injury; Boat Accidents; Brain Injury; Chemical Exposure; Construction Worker Accident; Defective & Dangerous Products (Product Liability); Drowning; Electrocution; Fires or Explosions; Head Injuries; Helicopter Crashes; Medical Malpractice; Mesothelioma & Asbestos; Motorcycle, Bicycle and ATV Accidents; Nursing Home Abuse; Paralysis; Pedestrian Accidents; Plane Crashes; Premises Liability; Railroad and Train Accidents; Segway Accidents; Slip-and-Fall Accidents; Spinal Injuries; Train and Locomotive accidents; Truck, tractor-trailer, 18-wheeler, and semi-truck accidents; Workplace Injuries; Wrongful Death.

- Automobile Accidents

Automobile accidents (including cars, trucks, buses, Segway crash, SUVs and tractor trailers) cause thousands of deaths and hundreds of thousands of injuries every year and carry the potential for both criminal and civil liability. While the State may only prosecute if someone is killed or if alcohol was involved, the lack of state prosecution does not affect the ability to pursue a civil case against drunk, hit and run, uninsured or underinsured drivers. Injuries suffered from automobile accidents can be severe and life altering. Victims and family members may be entitled to monetary compensation and may receive punitive damages in appropriate circumstances due to: Poor road conditions; Driving under the influence (DUI) of drugs or alcohol; Traffic Violations; Automobiles with Faulty or Defective Parts; General Negligence (Drowsiness; Distractions; Cell phone misuse; Aggressive driving; Speeding).

- Wrongful Death

Wrongful Death is a legal term that refers to death caused by unfortunate accidents or the negligence of another. Cases may arise as a result of a variety of incidents including: Medical Malpractice; Nursing Home Abuse; Defective Products; Auto Accidents; Construction Accidents; Aviation Accidents.

In times of great grief, it is obviously difficult for family members to understand the importance of a prompt investigation of the circumstances of death, preservation of evidence and identification of responsible parties. The Venardi Elam Firm will conduct an immediate and thorough investigation to ensure the family’s rights are protected, and will assist in the management of expenses such as: hospital bills; funeral and burial costs; your loved ones lost wages; loss of your loved one's companionship.

- Discrimination

Employees within the state of California and in the Contra Costa area have a variety of federal and state laws that have been instituted in order to protect them from discrimination by their employer. Under California law employers must provide equal treatment for employees in regards to promotions, termination, and general employment aspects and equal opportunity for all potential applicants that are able to perform the essential job functions of the position.

An employer cannot discount or otherwise make an employee ineligible due to factors including: race, color, national origin or ancestry; religion; physical or mental disability; medical condition; sex, pregnancy and childbirth, sexual orientation or gender; marital status; genetic characteristics; veteran status.

- Harassment

In California, both federal and state laws specifically outline how employers must treat their employees. The law outlines the civil rights granted employees to protect them from harassment in a hostile or offense workplace. Within these laws are categories of prohibited harassment that are in place to create a safe environment that extends equal opportunity employment to all workers and protects them from harmful physical attacks and unwanted verbal assault. These categories include: race, color, national origin, or ancestry; religion; sex, pregnancy and childbirth, sexual orientation or gender; marital status; age (40 and over); physical or mental disability; medical condition; veteran status.

With the Venardi Elam Firm, our attorneys are dedicated to protecting your civil rights when they are violated by employers or coworkers, and will file harassment litigation charges on your behalf. Our attorneys are experienced in taking cases to both state and federal trial, or negotiating settlements out of court, all while working efficiently toward a successful outcome of your legal situation.

- Whistleblower Protection

A whistleblower is generally described as one who discloses information regarding misconduct or corruption within a government entity or corporation that are in direct violation of the law. These whistleblowers can be current or former employees who have come forward to serve the public’s interest by helping to eliminate unlawful matters including fraud, waste and abuse. Under the Whistleblower Protection Act of 1989, these individuals are protected from suffering adverse consequences due to their actions.

When an employee is retaliated against for disclosing information, including negative workplace treatment or termination, that individual has the right to file litigation against that employer. With the California whistleblower attorneys at the Venardi Elam Law Firm, you can be ensured that your civil rights will be protected to fullest extent with efficiency and expertise. Our primary focus is to have justice served against those that would punish their employees and collect compensation for any inflicted suffering.

- Segway Accidents

Segway® Personal Transporters are two-wheeled electronic transportation devices that rely on self-stabilization. What most people fail to realize is that the Segway is not just a quirky device for moving people, but in fact is a vehicle that has all the same inherit safety risks as a scooter or motorcycle. With the capability to reach speeds of up to 13 miles per hour, there is a great potential for severe personal injury due to operator error, design or manufacturing defect.

The State of California enacted laws, which went into effect January 1st 2008. These laws have now set official regulations for Segway transporters, which are defined as an electric personal assistive mobility device (EPAMD). These regulations state that speeds for EPAMDs may not exceed 12.5mph and its operator/driver must yield to pedestrians’ right-of-way for the safety of persons or property.

- Insurance Bad Faith

The Venardi Elam Firm represents individuals who have suffered a loss and been mistreated by their insurance company. Sometimes the insurance company has denied the claim; sometimes it has provided an unfair settlement of a claim. The Venardi Elam Firm has extensive experience in representing consumers and homeowners who have been cheated or mistreated by their insurance company. We focus on insurance bad faith actions, including claims arising under homeowner and automobile policies.

- Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) is the process of resolving legal conflicts without going to trial. The Venardi Elam Firm advises clients on arbitration, international dispute resolution, mediation, mini-trials, and private judging. We have extensive expertise in determining when a form of ADR is in the best interest of clients and meets their needs better than traditional litigation. We have substantial experience and training in ADR and routinely advise our clients on the legal consequences of particular terms and conditions of all ADR options.

The Venardi Elam Firm is committed to resolving cases in an aggressive yet cost-effective manner and, where feasible, encourages clients to explore methods of alternative dispute resolution.
