Bankruptcy:
Chapter 7 bankruptcy, also referred to as liquidation, eliminates the debtor’s legal liability to pay unsecured debt, such as outstanding credit card bills, medical bills, unsecured personal loans, payday loans, judgments, etc. In return for eliminating the majority of your debt, some of your non-exempt property or possessions may be sold in order to help off-set some of your debt. It should be noted that Chapter 7 bankruptcy does not erase all of your debt. Certain debt cannot be eliminated in Chapter 7 bankruptcy, such as child support, alimonyspousal support, student loans, damages for personal injury accidents, and tax debt.
Chapter 13 Bankruptcy, also referred to as reorganization, is filed by individuals who want to pay off their debts over a period of years. This type of bankruptcy appeals to individuals who have non-exempt property that they want to keep. It is also only an option for individuals who have predictable income and whose income is sufficient to pay their reasonable expenses with some amount left over to pay off their debts.
