Practice Areas
Practice Areas Description
Our attorneys commonly handle cases including:- DUI
Our lawyers have extensive knowledge about: Misdemeanor and felony DUI; DUI stops and your rights; DUI punishments; DUI defense strategies; and DMV and driver's license issues. Whether this is your first DUI offense or you have been accused of this crime before and you must face the escalated penalties that come with repeat offenses, you can be confident in our ability to defend your rights and your driving privileges.
- Domestic violence
Our attorneys defend against all domestic violence crimes, including: Corporal Injury to a Spouse or Cohabitant; Domestic Battery; Criminal Threats; Child Abuse; Child Endangerment; and Elder Abuse. These crimes are made more complicated by restraining orders, which can have serious and life changing repercussions on their own. We fight criminal charges, as well as these orders.
- Sex crimes
If you are approached by the police or arrested in relation to a sex crime of any type, understand that you have the right to remain silent and the right to contact an attorney. The things you say to police could be used against you. We defend against all charges, including: Sexual assault; Rape; Internet sex crimes; Dating violence and date rape; Indecent exposure; and Public lewdness. Among the many penalties you will face if convicted, you will have to deal with sex offender registration. That alone is life changing. Strong defense requires early intervention, if possible. We do not believe in waiting to see what happens. We will begin our investigation immediately, doing everything possible to get you through this quickly and effectively.
- White collar crimes
White collar charges can be either state or federal charges. They may begin with an investigation. Whether you are under investigation or charged with a crime, remember you have the right to remain silent and the right to talk to an attorney. Making certain that you take advantage of these rights immediately can make a difference. We defend against all white collar crime charges, including: Business and corporate crimes; Embezzlement; Tax evasion and tax crimes; Fraud (securities fraud, Social Security fraud, health care fraud); Espionage; and Money laundering.
- Drug crimes
Whether you are under investigation or you have been charged, remember that you have the right to remain silent and the right to talk to an attorney. Take advantage of these rights immediately. We defend against all drug charges, including: Drug possession (possession of marijuana, cocaine, meth and other substances); Drug distribution; Drug trafficking; Drug manufacturing; and Drug conspiracy. Our goal is to minimize the impact these charges have on your life, so we are extremely familiar with drug charges and diversion programs.
- Theft and property crimes
Our attorneys can defend against all theft and property crimes, including: Shoplifting; Burglary; Auto burglary; Robbery; Embezzlement; and Vandalism. We understand how theft crime allegations can damage your life and your career. You can be confident in our ability to defend you against them. No matter what situation you have found yourself in, you have options. Our experience means we can find a defense strategy. If we cannot win your case, we may be able to negotiate or mitigate. We want to get you the outcome that has the least possible impact on your life.
- Assault
Whether you have been falsely accused or not, you need an experienced lawyer to protect your rights, who knows San Jose assault law to make sure you are treated fairly. At the Law Offices of Valencia, Ippolito & Bowman, our lawyers bring more than 65 years of combined experience to assault cases. Our team includes former criminal prosecutors, meaning we know firsthand how our opponents build these cases. We know their tactics. We have the experience to defend you against their tactics.
- Homicide
Homicide is the act of killing another person, either intentionally or unintentionally. It is perhaps the most serious crime you could be accused of, and the potential penalties you could face if convicted are equally serious. At the Law Offices of Valencia, Ippolito & Bowman, our lawyers bring more than 65 years of combined experience to homicide cases. Our team includes former criminal prosecutors, meaning we know firsthand how police and district attorneys build homicide cases. We know the tactics they use, and we know how to defend against those tactics to protect you.
- Three strikes cases
People are often surprised to find themselves facing unusually serious penalties thanks to California's Three Strikes law. There may be no relation between the crimes and the earlier strikes may have occurred many years ago, but that may not stop the prosecutor from trying to use three strikes against you. While California's Three Strikes law is complex, there are ways to fight it. Our lawyers bring more than 65 years of combined experience to these cases. Our team includes the attorney who tried the very first three strikes case in Santa Clara County.
- Gang cases
The underlying charges in gang cases can be anything from drug offenses and assault to theft and property crimes. When defending against these charges in a gang context, we start by attacking the charges themselves. Our motto is: there is no case that cannot be won, negotiated or mitigated. We will also attack the gang enhancement, striving to prove that the crime was not done to benefit a street gang. Many people face this enhancement even though they are not active participants in gangs. We will try to show that you are not a gang member.
- Juvenile crimes
If your child has been accused of a crime, it is important to understand that your child's future is on the line. The police showed up at your door and issued you a summons to appear with your child in court, but you do not have to go alone. In fact, you should not. You should enlist the assistance of an experienced criminal defense attorney who can work with the juvenile court to minimize the impact of the charges on your child's life. We understand how the juvenile court system works. We know how to maneuver through it with the goal of preventing anything that happens now from hindering your child's future opportunities. We have achieved a great deal of success in these matters.
- Professional license issues
Administrative hearings are quite a bit different than criminal hearings. These are not trials. They are run by administrative law judges, and there are significantly different rules. We know the rules. We know how to build your case for these unique hearings. We know how to tell your side of the story and protect your license. There may be other techniques that we will need to use to protect your license. Depending on your situation, we may have to clear your record. Our experience means we can quickly review your case and determine the best path to get you results.
- Record clearance
In California, there is technically no such thing as expungement and it is not really possible to seal a criminal record. However, you can clear your record, and that goes a long way. Are you eligible to have your record cleared? You may be. If not, there are steps that may be taken to make you eligible. For example, you cannot have your record cleared while you are on probation. Our attorneys have the experience to pursue early termination of probation in order to allow you to get your record cleared. After your record is cleared, we can help you get a certificate of rehabilitation.
