- Bankruptcy
If your debts have become unmanageable and you are facing the loss of your home or other possessions, bankruptcy offers different methods to wipe the slate clean and give you a fresh start with your finances. We can help you decide if bankruptcy is right for you and determine whether a Chapter 7 or Chapter 13 bankruptcy would be better suited to meet your financial goals.

- Foreclosure Avoidance
Your home is more than just your single greatest financial investment; it is the place where you make your life and share all the most precious moments with your family. Did the bank fully disclose the terms of your mortgage when you bought the home, or did they engage in deceptive and predatory lending practices? There are many ways to avoid a foreclosure. Don't give up your home without a fight.

- Second Mortgage Removal
Many people refinanced at a time when their home had become overvalued. With the market correcting, these second mortgages are disastrous to the struggling homeowner. Where appropriate, we can help remove that second mortgage, allowing you to stay in your home with a sense of security and a more realistic monthly payment.

- Arrearages
If you are behind on your mortgage payments or taxes, there are ways you can deal with those arrearages without losing your home or other property, or facing enforcement action from the IRS or Utah State Tax Commission.

- Repossessions and Wage Garnishments
If you finance the purchase of a car or home appliance, chances are your obligation to pay is secured by that car or home appliance, and the creditor may have the right to repossess it if you fail to pay on time. Other creditors may get a court order requiring your employer to withhold part of your wages and send them to the creditor. To avoid a repossession or wage garnishment, try to negotiate a workout or debt settlement before litigation is required.

- Lawsuits & Judgments
If legal action is being taken against you, you must respond. You may have several defenses available, including valid disputes as to the existence or amount of the debt. It may also not be too late to work out a payment that does not involve legal action. The one certainty is that if you do nothing, you will be at the mercy of the creditor who will receive a judgment on the most favorable terms available to it.

- Credit Establishment
If you have lost your job, run up your bills or maxed out your credit, you may think that you are a bad credit risk and unlikely to be able to obtain new credit. But even if you have filed for bankruptcy, there are still many steps you can take to establish or rebuild your credit. This process can begin immediately, with progress made in months, not years. Rebuilding credit, even after bankruptcy, is easier than you think.

- Tax Settlement
Only certain tax debts are dischargeable in bankruptcy. Whether or not you are filing for bankruptcy, if tax debt is one of your main problems, you may be able to solve it by negotiating an installment payment plan or offer in compromise with the IRS or Utah State Tax Commission. Tax debt will not go away and should not be ignored, or you may find the government has placed a lien on your property and may try to foreclose as a way to get their money.

- Debt Settlement
Most creditors would rather be paid than have to foreclose on your home or repossess your property. They most certainly would rather get paid than see you file for bankruptcy, which may very well shut them out from receiving anything at all. These factors can weigh in your favor and allow you to negotiate a lower amount in order to settle a debt.

- Loan Litigation
An attempt to foreclose on your home should be vigorously fought against, and there are many tools available to stop a wrongful foreclosure. The lender may have engaged in fraudulent or predatory lending practices, or violated federal disclosure laws when negotiating your loan. Also, the bank may not actually have the title to your property it claims to have, and may not actually have the legal ability to foreclose.

- Medical Bills and Credit Card Debt
Unsecured debt such as medical bills and credit card debt is the first to be discharged in a bankruptcy proceeding, and these creditors often get nothing if the debtor files for Chapter 7 or Chapter 13. Armed with this knowledge and ability, we can help negotiate a debt settlement or other type of debt relief.
