Practice Areas Description
Wagner Sidlofsky LLP provides legal representation and services in the following areas of practice:- Estate Litigation
Those few law firms in Toronto that focus primarily on estate litigation have an edge because this is a niche field with its own rules, conventions and procedures. Estate litigators require a different skill set that comes from a constant exposure to the nuances and subtleties of this specialized field of law. Charles B. Wagner and Associates honed their expertise by focusing on this specialized area. To excel, these estate litigators combine an assertive intensity with analytical ability and negotiating prowess flowing from an understanding of the family dynamics intrinsic to estate litigation. We believe that resolution of disputes happen quicker when litigation is prosecuted assertively and quickly.
- Commercial Litigation
At Wagner Sidlofsky LLP, our lawyers are experienced and successful in dealing with commercial disputes in the boardroom, at trial and on appeal. Their accomplishments, in part, are based on aggressive intensity, experience, and up-to-date knowledge of the law. Equally important is their expertise in negotiations and lateral out of the box approach to problem solving. Charles B. Wagner and Gregory Sidlofsky have substantive experience in both business and law.
• Administrative Law
Lawyers at our firm have represented clients before such regulatory bodies as the Ontario Rental Housing Tribunal, the Alcohol and Gaming Commission of Ontario, the Real Estate Council of Ontario, and others. We have also had dealings with the College of Physicians and Surgeons, the Professional Engineers Ontario, the Ontario Securities Commission, and others.
• Breach of Contract
Our Toronto law firm handles litigation arising from all types of contractual breaches. We have experience litigating breach of contracts pertaining to commercial contracts, employment contracts, contracts for the sale of land, breaches of verbal agreements and many others.
• Civil Fraud
Lawyers at our firm have been involved in numerous fraud cases on behalf of aggrieved plaintiffs. We have successfully obtained judgments in a number of investment related frauds, franchise frauds and frauds involving other business relationships. In addition to obtaining judgments covering the losses stemming from the frauds, we have been successful in obtaining hundreds of thousands of dollars in punitive damages awards on behalf of our clients.
• Commercial Tenancies Disputes
Our firm has substantial experience acting on behalf of commercial tenants as well as landlords in litigating disputes over commercial leases. We are experienced in dealing with evictions, relief from forfeiture and damages cases involving breaches of lease and other landlord/tenant disputes.
• Construction Liens
The lawyers at our law firm in Toronto have experience acting for property owners, general contractors and trades on lien claims. On behalf of property owners we have successfully challenged the validity of construction liens as well as the timing of registration of construction liens. Our Toronto law firm has also obtained recovery for trades and contractors who have had to register construction liens to compel payment of their outstanding accounts.
• Debt Collection
Our Toronto law firm is experienced in debt collection and in taking the steps necessary to force debtors to pay. We regularly take debt collection steps to enforce judgments including conducting examinations in aid of execution (judgment/debtor examinations), obtaining writs of seizure and sale as well as garnishing bank accounts and salaries.
• Defamation
Lawyers at our Toronto law firm have been involved in litigation on behalf of aggrieved plaintiffs who are the subject of defamatory statements as well as on behalf of defendants who are accused of defamation. We are also experienced in acting on injunctions brought to restrain defamatory conduct and to compel the removal of defamatory materials from the internet and print.
• Directors’ and Officers’ Liability
Our firm regularly acts for and against directors and officers of corporations. We have successfully held directors and officers liable in oppression and other claims including most recently before the Court of Appeal of Ontario. We have also successfully acted for directors and officers in defending personal claims and in having such claims struck out early in proceedings.
• Wrongful Dismissal
Our firm regularly acts for employees as well as employers in wrongful dismissal claims. We have substantial experience in constructive dismissal claims, claims involving allegations of just cause, etc. The law concerning wrongful dismissal regularly changes. The lawyers at our firm are up-to-date on changes in employment law concerning the availability of punitive damages, damages formerly known as “Wallace” damages, extending the period for pay in lieu of notice, etc.
• Enforcement of Foreign Judgments
Our firm is regularly retained to enforce judgments obtained by clients in other jurisdictions as well as to oppose the enforcement of such foreign judgments in Ontario.
• Mortgage Litigation and Enforcement
It is often necessary to go to court to enforce a mortgagee’s rights or to defend a property owner against mortgage enforcement and the loss of his or her property. The lawyers at our firm regularly act for mortgagees and mortgagors in such matters, including most recently and successfully in the Court of Appeal for Ontario.
• Oppression Remedy
Lawyers at our firm have been successful in all levels of court in Ontario in pursuing oppression remedy claims against aggrieved shareholders and ousted officers and directors. We have obtained substantial judgments and have regularly argued appeals involving oppression remedy principles.
• Real Estate Disputes
We are regularly retained to handle litigation over breached agreements of purchase and sale, breached warranties, latent defects, etc. Many of these cases we handle involve claims for specific performance, the registration of certificates of pending litigation and damages. We also regularly obtain or resist injunctions and mandatory orders pertaining to properties.
- Elder Law
We are often called upon when vulnerable elderly people are victimized resulting in a loss of an inheritance by disappointed beneficiaries. The reliance on other people often make the elderly especially susceptible into being unduly influenced into making gifts, changing their wills or even marrying caregivers. Our firm specializes in handling these types of will challenges. We are also often consulted by people whose family member can no longer understand how to take care of their finances or care for their health. In these instances, when people do not have powers of attorney, their family’s only option is to go to court.
Our firm is familiar with the law and procedures to be followed when someone becomes incapable. Under The Substitute Decisions Act we apply to court for the appointment of our client as statutory guardian. With the appointment, the family member now has the legal authority to make decisions for the incapable person who can no longer manage their finances, property or personal care.
