- Family Law

- Child Custody/Guardianship

At the Illinois law firm of Wakenight & Associates, P.C., we focus on helping clients assert their rights to further the Best Interests of their children We help clients put aside their anger and educate them about their options in child custody and guardianship matters. We cater to the three basic types of child custody in Illinois — joint custody, sole custody and shared custody.

- Child Support

We represent both men and women in child support matters. Regardless of whether our client receives or pays child support the formula is straightforward and predictable. Here are some areas that we look at in any child support matter: Second job income; Student loan payments; and Business-related expenses and income. Child Support is one area where many Courts pay special attention because they take their role of protecting the children's finances very seriously. Any agreement which clients make on their own, outside of Court will have to comport with standard guidelines for the agreement to be entered as an order of court.

- Divorce

Divorce is usually more than determining that you are no longer married. We are well versed on all of the issues that may come up in a divorce proceeding including: Children Issues: Matters related to children include custody, visitation and child support; Money Issues: It is the goal of the Court to sever the economic ties between the parties. Property and debt will be divided and the spousal support addressed, if appropriate; Settlement: Most divorces are resolved by agreement. Once the financial and other facts are known and the law applied, a fairly predicted and anticipated outcome at trial will form the basis of the settlement. The best way to secure a settlement is to prepare for trial; and Trial: If the parties cannot agree and independent third party, the Judge, will hear the testimony, consider the evidence, apply the law and enter a Judgment.

- Emergencies

We cannot reiterate strongly enough the importance of calling the police if you feel threatened or in danger. However, there are other emergencies that require timely attention, but do not require you to visit the police station. Our law firm can help with emergencies such as: Filing or contesting orders of protection; Helping you follow through after temporary orders of protection were issued; Responding when the other parent refuses to let you remove a child from the state for vacation; Responding when the other parent fails to return a child after scheduled visitation; Wondering whether the other parent has a drug problem or is allowing friends who use drugs to be around the child; Worrying that the child may be an abuse victim; and Helping Grandparents seeking emergency custody of a child.

- Maintenance/Alimony

Unlike child support, which the Court must enter in accordance with set guidelines, the issue of spousal support has no set guidelines is left to the Court's discretion. There are many factors which the Court may find relevant in analyzing whether or not to order maintenance but most important is the length of the marriage, the age of the parties and their comparative wages and wealth. The shorter the marriage, the younger the parties and the more equal their incomes, then the less likely it is that the Court will order maintenance.

- Money Issues

Under Illinois Law all property acquired by either party subsequent to the marriage is marital property, except for certain property defined as non-marital property such as property acquired by gift, legacy or descent. The threshold property analysis is, thus, to determine what assets make up the marital estate. The next step is to prove the value of the assets. At Wakenight & Associates, P.C., our lawyers help clients resolve many money matters that arise during divorce proceedings.

- Paternity

Time is a crucial element in every Parentage case. Failure to promptly assert parental rights can result in your child being removed from the State or even adopted without your consent. Not until Parentage has been established do the usual parenting issues of custody, visitation and support apply. Our family law attorneys can help with any type of paternity matter. - Post- Judgment Issues

Our attorneys handle all types of post-judgment matters.
