- Foreclosure Law

Utah primarily operates as a title theory state, meaning that the property title remains in trust until the borrower has paid the mortgage in full. If the borrower defaults on the loan, the trustee has the authority to sell the house at auction and is not required to take action through the court system to foreclose. In a recent court case, California courts ruled that a private right of action exists for violations of CA Civil Code 2923.5.
