William D. Weber, the firm's prin­ci­pal law­yer / at­tor­ney, is board cer­t­i­fied in con­sumer bank­rupt­cy law by the Texas Board of Le­gal Spe­cial­i­za­tion. He grad­u­ated in the top 6 per­cent of his law school class at the Uni­ver­si­ty of Hou­ston Law Cen­ter and re­ceived his Texas law li­cense in 1983. Dur­ing his 28 years as a prac­tic­ing law­yer / at­tor­ney, he has ob­tained a broad range of ex­pe­ri­ence in small busi­ness and con­sumer bank­rupt­cy, bankruptcy lit­i­ga­tion and debt col­lec­tion mat­ters, and has con­cen­trated on rep­re­sent­ing debtors (both busi­ness and con­sumer) and cre­di­tors in bank­rupt­cy cases, and bank­rupt­cy re­lated lit­i­ga­tion. He also has sig­nif­i­cant ex­per­i­ence han­dling in­vol­un­tary bank­rupt­cy cases filed by cre­di­tors.

Mr. Weber especially enjoys handling Chapter 11, Chapter 12 and Chapter 13 re­or­ga­ni­za­tion cases, and bankruptcy litigation. Most lawyers do not like bankruptcy litigation and will refuse to litigate complex issues that arise in Bank­ruptcy Court, such as discharge contests, preferences, fraudulent conveyances, exemption contests, mortgage claims and stay violations. Although most bankruptcy professionals dislike litigation, Mr. Weber enjoys the challenge involved in handling contested bankruptcy litigation cases. - Debtor Representation

• Chapter 7: Straight bankruptcy. Allows individuals to eliminate most unsecured debts, keep property and get a fresh start. Chapter 7 is commonly known as a "liquidation" proceeding, but this term is a misnomer since approximately 99 percent of all individuals keep all of their property in a Chapter 7 case.

• Chapter 11: Business reorganization for corporations, partnerships and individuals. Allows corporations and partnerships to reorganize by proposing a plan to eliminate or lower payments on debts and avoid unfavorable contracts.

• Chapter 12: Small business reorganization for family farmers and fishermen. Available to corporations and individuals. Similar to Chapter 13 in procedure.

• Chapter 13: Reorganization for individuals with consumer (personal) or small business debts through a court supervised repayment plan. Allows most individuals to repay debts over a 3 to 5 year time period, and eliminate or lower payments on certain debts.

- Creditor Representation

• Stay Motions: Proceedings to lift the automatic stay and allow creditors to foreclose on land or repossess vehicles or other collateral.

• Plan Objections: Objections to confirmation of Chapter 13 plans.

• Valuation Disputes: Objections to debtor valuation of vehicles or other collateral.

• Dismissal Motions: Motions to dismiss repeated or abusive bankruptcy filings.

• Discharge Contests: Contesting the discharge of a debt in bankruptcy due to fraud or other abusive debtor conduct.
