The Weimer and Boyce Attorneys were police officers in the Commonwealth of Virginia before they pursued their careers of defending those accused of serious crime(s) and personal injury. Their knowledge and insight into how investigations are carried out, how the court process work, and what needs to be done for their clients best interests, are ways their previous careers in law enforcement has given them experience.
The charge is not what matters in criminal defense cases, proof is what matters. The prosecutor is obliged to prove that defendants do not have anything to prove. We carry out our own investigation just like we do in civil cases. It is our job to decide whether there is sufficient evidence for the prosecutor to convict. Even if they do, it is still possible that they might not be able to prove it beyond reasonable doubt in court, and then the defendant is not guilty.
However, if it is proven in court, we do our best to lessen the effects on our clients by weighing the advantages and disadvantages of any plea, conferring with the client, keeping him or her updated.
The law firm of Weimer and Boyce possesses knowledge regarding how courts function, how investigations are done, and what is needed to be done to control facts and evidence in a case due to our long experience. Contact us on our number for us to let you know how we can help.
Practice Areas
Practice Areas Description
- DUI / DWIA conviction for Virginia DUI / DWI can result in jail time, expensive fines, and VA DUI laws may mandate the suspension or revocation of your driver's license. At the law office of Weimer & Boyce, we represent and defend clients arrested for DUI / DWI. Depending on your driving record and the circumstances surrounding your arrest, we may be able to reduce the charges or sentence against you. If there are strong reasons for calling into question the actions of arresting officers, we will challenge the evidence against you and the constitutionality of the decision to pull you over. As former police officers, we have first-hand experience with the procedures and protocols that must be followed when pulling someone over for suspicion of DUI, how a field sobriety test must be administered, and what must be done to challenge the results of a breath or blood test. In many cases, we can help clients avoid the loss of their license and maximum sentencing when jail or fines are involved.
- Criminal Defense
Regardless of how serious the charges may be against you, a conviction will depend on what a judge or jury hears, how they perceive the actions of police officers and investigators, and whether or not they believe prosecution witnesses to be credible. As former police officers, Weimer & Boyce understand how to expose and underscore weaknesses in the prosecution's case against our clients. Our staff members with law enforcement experience means we understand how a crime scene should be secured and handled, how interrogation tactics can cloud a suspect's judgment, and how to identify questionable actions on the part of police officers and investigators. We regularly work with forensic experts, lab technicians, and other professionals in challenging the validity of blood, hair, and fiber samples, fingerprints, DNA analysis, and other evidence offered against our client.
- Reckless Driving
Reckless driving is a serious offense in Virginia, especially if you already have convictions for other serious traffic-related offenses on your record. Depending on the facts surrounding your arrest or ticket, extenuating circumstances may convince a judge to reduce or dismiss the charges against you. At the law office of Weimer & Boyce, we explore alternatives to jail, fines, and suspension of your driver's license in cases involving reckless driving charges. In certain instances, enrollment in driver's training courses, volunteering for community service, or seeking counseling for anger and substance addiction issues may convince the court to reduce your sentence or the charges against you. In other cases, actions on the part of officers may call into question the constitutionality of your being pulled over.
- Traffic Offenses
Although traffic offenses may seem minor, they can create substantial financial and legal difficulties if treated in an improper manner. Since traffic infractions are reported to the state, insurance companies can discover when a driver is cited for speeding, running a stop light, ignoring a crosswalk, or other moving violations. At the law office of Weimer & Boyce, our lawyers take steps to reduce or eliminate the adverse financial and legal consequences of traffic offenses. Depending on your driving record and the facts of your case, we may be able to reduce or eliminate the charges and sentence against you. In doing so, you may avoid points against your license, increased insurance rates, jail time, and expensive fines.
- Commercial Driver's License
Truck drivers and others with commercial vehicle drivers licenses face serious consequences when arrested or ticketed for DUI, reckless driving, speeding or other serious moving violations. Depending on the charges or citation involved, you face the loss of your commercial license AND the suspension of your regular driver's license. A conviction for a serious traffic violation could impact your ability to work, the cost of your insurance premiums and your record. At the law office of Weimer & Boyce, our lawyers represent and assist truck drivers, cab drivers, bus drivers, and delivery truck drivers in cases involving serious traffic offenses.
- Drivers License Reinstatement
In most cases, people whose driver's license has been suspended or revoked can petition the State of Virginia to reinstate their license. While some traffic offenses and DUI convictions may result in a mandatory suspension or revocation period, reinstating your driver's license requires an understanding of the law and what steps need to be taken to convince the court you are prepared to drive responsibly. Even in cases involving habitual DUI offenders, measures may be taken that will allow you to resume driving, albeit under restricted or monitored conditions. At the law office of Weimer & Boyce, our lawyers prepare and represent clients in cases involving the reinstatement and restoration of driving privileges.
- Personal Injury
The cost of a personal injury can be substantial, especially when injuries prevent someone from returning to work for weeks or months. At the law office of Weimer & Boyce, our personal injury lawyers are committed to recovering financial losses for individuals and families facing mounting medical bills and lost wages. Our office regularly works with medical experts, accident investigators, engineers, and other professionals in determining the cause of an accident and who is to blame. Our years of experience as personal injury attorneys have allowed us to cultivate an in-depth understanding of the insurance business, how it operates, and the tactics used to minimize claim payouts. We defend our clients' rights and interests, presenting the strongest possible so that we may negotiate from a position of strength.
- Car Accident
Serious, catastrophic injuries resulting from auto accidents typically involve ongoing medical expenses, lost wages, and a reduction in quality of life. At the law office of Weimer & Boyce, our attorneys work closely with accident investigators in determining what happened and why. Since insurance companies typically defend themselves by trying to place all, or a portion of the blame on the victim of a car accident, we expose negligence on the part of car, truck, and bus drivers who cause wrecks in the first place. By measuring skid marks, analyzing damage to the vehicles involved, recovering traffic camera footage, and interviewing eyewitnesses, we place responsibility firmly on the other driver, demanding nothing less than fair compensation for our client's injuries.
- Wrongful Death
Negligence or a reckless indifference to the well-being and safety of others on the part of manufacturers, drivers, employers, or doctors can be grounds for a wrongful death suit when fatalities occur as a result. The law office of Weimer & Boyce investigates fatal accidents involving dangerous products, medical malpractice, drunk driving, traffic accidents, truck accidents and deadly construction accidents. We work closely with design engineers, forensic specialists, safety experts, and other professionals in determining why an accident happened and how it could have been prevented.
- Nursing Home Negligence
Nursing homes are licensed by the state and are therefore required to submit to inspection and adhere to certain regulations and protocols. When abuse or neglect occurs, a violation of certain regulations and statutes is almost always involved. At the law office of Weimer & Boyce, our attorneys work with investigators, medical experts, and inspectors in cases involving nursing home abuse and neglect. Our office subpoenas staffing records, employee files, video footage (if available), copies of internal memos, and information regarding former complaints or citations involving a nursing home. Our lawyers interview attending staff and managers regarding policies and procedures, as well as investigate circumstances surrounding the injuries suffered by our client. We expose contradictory testimony, failures of oversight, and attempts to cover up incriminating evidence.
- Product Liability
Manufacturers and retailers can be held financially liable for injuries and deaths caused by defective products. While a manufacturer may adhere to product safety specifications in the design and manufacture of a product, they can still be held liable for design flaws and product defects. Even though existing legislation may not address all relevant dangers inherent in a product (or its design), a manufacturer can still be held responsible for injuries and harm caused by that product. If a jury finds that a manufacturer should have foreseen certain dangers inherent in a product's design, they can be held liable for injuries that occur as a result - regardless of whether the product conforms to certain standard industry specifications. For example, there is no law regulating how strong a roof must be on a car. However, car manufacturers can still be held liable for injuries and deaths that occur as a result of "roof crush."
