Law Firm Overview
The Law Offices of Wendy Raquel Hernandez, P.C. focuses on two main areas of law: family law and criminal defense. Our firm was founded by a former criminal prosecutor, attorney Wendy Raquel Hernandez, who has handled more than 100 trials. Every client works with Ms. Hernandez and our entire team of advocates.
At the Law Offices of Wendy Raquel Hernandez, P.C., we are proud of the creative and practical solutions we provide for our clients. We are just as proud of the methods we use to achieve results for our clients. We would be proud to be of service to you, too.
In addition to the down-to-earth atmosphere, we also offer clients a nonjudgmental environment. We are not here to judge you or your situation, but rather to help guide you through a difficult time today so you can reach a better place tomorrow. Our only goal is your satisfaction, and we will use all our ability, skills and knowledge to meet that goal.
In our experience, the "win at all costs" approach some lawyers use typically results in neither happy clients nor effective solutions. In our view, this approach only succeeds in generating more fees for the attorneys or the law firm handling the case.
We believe in being honest with our clients. We believe in handling our clients' highly emotional cases with patience and gentle reasoning. Protecting your interests AND getting you through the legal process with the least amount of financial and emotional damage is possible.

Additional Practice Areas: Military Divorce; Enforcement of Child Support; Child Custody Rights Outside of Marriage; Fathers' Rights; Grandparents' Rights; Same-Sex Custody Issues; Restraining Orders; Victims of Spousal Abuse; Dissolution of Same-Sex Partnerships; Vehicular Homicide; Forgery
Practice Areas Description
Our practice encompasses the following:- Divorce
Our law firm provides an open and relaxed environment where clients feel free to talk about the difficult aspects of divorce with honesty and without the fear of being judged. Everyone in our office — attorney and staff — is here to help and shares one common goal: your satisfaction. As a divorce lawyer, Wendy Raquel Hernandez offers clients in the Phoenix metro area and throughout Arizona a full spectrum of divorce and divorce-related legal services: Collaborative law divorce; Military divorce; Pitfalls of do-it-yourself divorce; Child custody, child support and alimony; and Property division issues.
- Child Custody
We know the damage that can be done to children as the result of a child custody fight. We also know from experience that no one wins, not the mother, not the father, and least of all the children, when this issue has to be decided in court. Because of this, we never lose sight of what it really means to protect the best interests of the children in our divorce practice. Some of the specific child custody issues we handle include: Parental relocation; Custody issues for same-sex parents; Joint custody; Sole custody; Visitation / parenting time; Child support; Post-divorce modification; Custodial parent relocation; and Mandatory parent education class enrollment.
- Child Support
We help our clients compile and document the information they need to ensure that the child support amount set by the court is not too high or too low. In cases where the parties were not married, it may be necessary to have a child support order in place. Our office can obtain a court order for DNA testing to determine who the father of the child is and whether support is necessary. In addition to these services, our child support practice also involves handling post-divorce issues such as obtaining modifications and the enforcement of support orders.
- Alimony / Spousal Support
To qualify for spousal support in Arizona, you must meet at least one of the criteria outlined in Arizona Revised Statutes 25-319 (A). If one of these criteria is met, accurate documentation of financial information and the marital lifestyle is essential to a fair result. Our law office represents spouses on both sides of this issue in the Phoenix Metro Area and throughout Arizona. Our practice includes both temporary and permanent alimony issues, as well as post-divorce modifications and the enforcement of existing support obligations.
- Property Division
* Property division: Arizona law requires all assets acquired during marriage to be divided equitably between the two parties. Only inheritances and personal gifts are excluded from this requirement. We can help you obtain the full amount of assets you are entitled to receive. * High net worth divorce: Attorney Wendy Hernandez is skilled in the division of complex assets, including businesses, investments, retirement accounts and pension plans, real estate and more. We also understand that issues of child support can become complicated in families possessing significant assets. * Hidden assets: Divorce can bring out the worst in people, including dishonest attempts to deprive their spouses of their fair share of marital property. We know where to look and how to bring hidden assets back into the marital estate.
- Fathers' Rights
Our law firm has successfully represented fathers who were divorced long ago when the child custody laws and societal beliefs were different. In many of these cases, the child custody and visitation agreements gave the fathers very little time with their children. Still, even as children grow older and express a desire to spend more time with their fathers, it can still be a tough battle without aggressive legal help. We are proud of our success on behalf of fathers who want to change the status quo, spend more time with their children, and demonstrate they are capable and willing parents.
- Grandparents' Rights
We have extensive experience representing grandparents who need help securing custody of or visitation rights with their grandchildren. Grandparents' rights continue to evolve as an increased number of grandparents file petitions for visitation rights or custody. Because our law firm frequently represents grandparents, Attorney Hernandez knows the most current state of the law regarding grandparents as related to their grandchildren.
- Same-Sex Custody Issues
We are proud to represent gay and lesbian parents who need help negotiating a visitation agreement after separating from their partners. We believe in helping our clients take control over their family law problems by using negotiation and compromise, rather than taking a fight all the way to a family court judge. In our experience, when couples resolve their problems themselves, they are more invested in the outcome. Situations exist, however, where compromise is impossible. In these cases, we have the skills to advocate successfully for our clients in the courtroom.
- Other Family Law Issues
We provide comprehensive legal services in family law to clients in Phoenix and throughout Arizona. You can rely on our experience and skill to help you with a broad range of legal issues, including those involving:
* Adoption: Including stepparent adoption, grandparent adoption, open or private adoption, and international adoption.
* Prenuptial agreements: We draft, review and litigate disputes over prenuptial and post-nuptial agreements.
* Child abuse: We represent clients in disputes over child custody and termination of parental rights in which child abuse becomes an issue.
* Restraining orders: We help protect victims of domestic violence by obtaining orders of protection and also defend clients against the imposition of these orders. We can also assist with accusations of and criminal charges resulting from alleged restraining order violations.
* Victims of spousal abuse: With experience in family law and criminal law, attorney Wendy Raquel Hernandez is well positioned to help protect victims of spousal abuse and their children.
* Domestic violence: We are dedicated to protecting the victims of domestic violence and equally committed to defending those who are falsely accused of these actions.
* Mediation services: Ms. Hernandez has and continues to serve as a mediator in family law disputes.
* Dissolution of same-sex partnerships: Arizona law offers little guidance for same-sex couples who decide to end their relationships. We can protect your interests and help you negotiate, mediate or arbitrate a fair resolution to disputed issues.
- Criminal Defense
Our criminal defense practice ranges from petty misdemeanors to felony murder and includes other charges such as: Domestic violence; DUI / drunk driving; Vehicular homicide; Drug possession, sales, manufacture, and trafficking; Theft / auto theft; Assault and battery; Burglary / robbery; and White collar crime (embezzlement, fraud, forgery). As a former prosecutor who has handled more than 100 jury trials, attorney Wendy Raquel Hernandez is completely honest with clients from the start. If the case against you is strong, she will not sugarcoat the truth. However, no matter what the charge or evidence is, we will always strive for the best outcome possible in your case.
