Practice Areas Description
William C. Cremins, P.C. provides legal representation and services in the following areas of practice:- Divorce
Attorney William C. Cremins will work with you to determine in which court to seek a divorce, and upon which grounds to file for, or defend, your divorce whether it involves a contested or uncontested divorce in Knoxville and throughout East Tennessee. Some clients file their own paperwork and then seek legal counsel, not knowing they may waive legal rights by filing self-prepared documents to start or answer a divorce. It is important that you not file any documents to begin or answer a divorce case until you have spoken to a lawyer.
- Workers' Compensation
Attorney William C. Cremins helps those hurt on their jobs recover from their employers, or their employers' workers' compensation insurance company. He also helps obtain workers' compensation benefits for the families of workers killed while working.
- Custody and Child Support
New Tennessee laws refer to a child's custodian as the "primary residential parent," refer to the noncustodian as the "alternate residential parent," and refer to visitation as "co-parenting time." Child support was once determined based upon a percentage of the noncustodial parent's income. Now in Tennessee, the presumed child support obligation is now determined with a support calculator. The practice includes Juvenile Court representation, including paternity, dependent and neglected children.
- Domestic Violence
Orders of Protection against domestic violence may be sought if you are being stalked, or if a family member or someone who lived with you is harming or threatening to harm you or if your property is being destroyed.
- Property
Property is divided by the courts into married or separate property. Tennessee divorce courts divide marital property in a way that is deemed fair according to the law.
- Family Law
Attorney William C. Cremins works for both men and women in divorce and child custody cases, including setting appropriate child support, visitation schedules, appeals, and other matters. The fee for family law cases is an hourly rate plus a retainer.
- Adoption
Adoption law in Tennessee requires certain procedures be followed. While these may be time-consuming, the result is a happy addition to the family.
- Paternity and Visitation via Juvenile Court Orders
In juvenile courts or divorce courts, Tennessee paternity lawsuits are filed by either fathers or mothers to establish rights and relations between parents and children. Mothers or fathers may seek custody or visitation rights, child support or other orders regarding their children. DNA testing may be required to determine paternity, either by agreement of the parties or by orders of the courts.
- Dependent and Neglected Children
Tennessee Code Annotated Section 37-1-102(b)(12) defines "dependent and neglected" children. Children within this definition may be taken into the custody of the Tennessee Department of Childrens' Services.
- Personal Injury
I am William C. Cremins, Attorney at Law. I help those who suffer injuries or losses when others cause, or substantially contribute to causing, the harm or death. Tennessee law allows almost every insurance company to be reimbursed for health care bills that it paid, but only when a verdict or settlement is obtained. Typical fees for this kind of work amount to one-third of any verdict or settlement.
- Premises Liability
Owners and users of property owe a duty to those on the property. While no one can guarantee a place will be one where no one may possibly be hurt, owners and property users have a duty to take all reasonable precautions to safeguard visitors. Laws exist to ensure visitors will have safe places to go, such as those requiring handrails in certain places or those requiring slopes of walkways be no more than a specific angle. Security may be required in some areas, especially if a duty to safeguard guests is assumed or promised.
- Products Liability
If a manufacturer makes something that is unreasonably defective or dangerous, the manufacturer may be liable for injuries or deaths caused by its products. The fee for products liability cases is 40% of any verdict or settlement.
- Truck Accidents
Federal and state laws require much of truck drivers, and some don't or won't comply. Most truckers are fine, professional drivers, but sometimes accidents do happen. Truck crashes can have devastating effects. I have represented victims of truck crashes who sustained all kinds of injuries.
- Wrongful Death
Tennessee law allows the next of kin to bring a lawsuit seeking compensation for the pain and suffering of a person killed by another's acts. Final medical bills, ambulance bills and burial expenses may be recoverable. Lost wages which the next of kin would have enjoyed, as well as compensation for the loss of the guidance, direction, love and companionship may also be recoverable. I have literally had clients phoned by insurance adjusters as the clients prepared to go to the funerals of their loved ones. Do not let anyone press you to settle during a time of mourning, because a settlement agreement may be permanently binding upon you and your children.
