A patent is a right granted to an inventor by the federal government for the inventor to be the only one to make his/her invention, to use it, to offer it for sale, to sell it, or to import it into the United States for a period of twenty (20) years for utility patents. The only two ways to protect your invention are by a patent or by keeping it secret. Unfortunately, keeping your invention secret is very difficult, because once you sell your device or practice your method, others can “reverse engineer” and figure out how to make your device or use your method. A patent can only be awarded if your invention has not been done before and is not so closely similar to previous inventions that your invention would be obvious. A patent search is a review of previous patents and publications to see what has previously been done.
- Trademarks
A trademark is a word or phrase, or a logo that identifies you as the source of goods. A service mark is the same, but for services. Both are commonly called trademarks. While you will have common law rights in your trademark merely by using it with your goods or services, registration gives you powerful new rights. In particular, you can obtain statutory rights that may permit you to win an award of attorney fees when someone infringes your trademark. By filing a federal trademark, you may be able to prevent others from utilizing your trademark throughout the United States.
- Copyrights
Copyright arises from your conversion of your creative artistic expression into a tangible form. When you write a novel, a poem, take a picture, perform or write music or lyrics, make a video recording, draw a picture, paint a painting, you have created a copyright that you own. However, if you do any of these for someone else, you may not own the copyright under works-made-for-hire rules. More importantly, you cannot enforce your copyright without a registration on file. Registration gives you the right to sue, including statutory damages up to $150,000, and the ability to potentially get an attorney fee award. Since 1978, copyright lasts for 70 years plus the life of the author (last to die for joint authors), or for works-made-for-hire, 95 years from the date of publication or 120 years from creation, whichever comes first.
