Practice Areas Description
As elder law attorneys we assist seniors, veterans and families throughout all of Michigan with the following matters:- Medicaid
Applying for Michigan Medicaid can be a confusing process. Unfortunately, there are too many organizations out there offering their assistance, including nursing homes, social workers, insurance salesmen, and financial advisors. All of these other individuals may not have your loved ones best interests at heart. That is why it’s important to work with a qualified Michigan elder law attorney who can help you navigate the Michigan Medicaid process.
- Nursing Home Crisis Asset Protection
When a Michigan loved one or family is facing the daunting cost of a monthly nursing home bill of $5000-$9000, that can put an amazing strain on the family and the family’s life savings. You don’t have to watch your hard earned life savings be eaten before your eyes by the cost of skilling nursing home care. There is another, perfectly legal way. Allow us to guide you through all the confusing and misinformation to a plan that can protect your families life savings.
- Estate Planning
The Michigan Elder Law Center helps seniors, veterans and their families with all of their estate planning needs. The estate planning attorneys of Witzke Berry Carter & Wander PLLC help individuals plan and protect for the people they love. Our estate planning attorneys utilize a variety of different tools to assist people throughout Michigan with their estate planning. Using revocable living trusts, wills, powers of attorney, HIPAA authorizations, legacy deeds, quit claim deeds, warranty deeds, stand alone retirement plan trusts and the other tools available we craft customized estate plans to meet each individual’s or family’s goal.
- Michigan Legacy Deed
The Michigan Legacy deed is a relatively new approach at handling the estate planning and elder law issues involved in handling real property, including your home. The legacy deed is an innovative way that in many respects, we can “have our cake and eat it too” when protecting the home. That’s the purpose of the legacy deed, to protect the home.
- Estate Recovery
Medicaid is the governmental program that uses tax payer money to pay for the health care and long-term care services. The main use of Medicaid in Michigan is paying for the cost of a skilled nursing facility. Theoretically, estate recover is implemented to help return taxpayer money that was used to pay for these services. I say theoretically because of trying to recover assets or place liens on a Medicaid recipient’s assets probably costs the tax payers more than the recovery yields.
- Alzheimer’s Legal Planning
While it is important for every in Michigan to plan for the future, it is especially important for the person diagnosed with Alzheimer’s or dementia to seek counsel from an Alzheimer’s planning lawyer. When a person is diagnosed with dementia, family, friends and loved ones should help the person make take the necessary steps to contact an elder law Alzheimer’s lawyer to help the family begin developing a long-term care legal plan. The sooner the planning begins the more likely it will be that the person with Alzheimer’s or dementia will be able to participate in the legal planning. This legal planning may include making plans for health care and long-term care coverage, making plans for finances and property, and placing legal authority in others to make decisions on behalf of the person with dementia or Alzheimer’s.
- Veterans Benefits
As Michigan elder law attorneys who are accredited by the Veterans Administration, we are committed to helping Veterans get all the benefits they are entitled to and making the qualification process as stress-free as possible. We believe Veterans’ Benefits are an important, and sadly, under-utilized tool to help America’s heroes care for themselves and the people they love.
