Wolf, Baldwin & Associates, P.C. is a general practice law firm with offices in Pottstown, West Chester and Reading, Pennsylvania. In our practice, we handle a wide variety of legal issues, and we represent individuals from all walks of life, as well as business clients large and small.
In addition to our general practice areas, we represent clients throughout the entire workers' compensation process, including prosecuting and protecting their rights, assuring proper payment of their medical expenses, and negotiating fair and just settlements of their claims. In this regard, we are one of the larger firms in the tri-county area of Montgomery, Berks, and Chester Counties, with three attorneys dedicated almost exclusively to protecting our clients in their workers' compensation claims.
We want our clients to be comfortable talking with us and to know that we are available to answer their questions and address any concerns that might come up during what could be a long process. We pride ourselves on keeping lines of communication open and keeping our clients informed, and we do our best to return client calls and e-mails promptly.
When working with us on your unique case, you can be confident that the resources of the whole firm will be at your service. For instance, an injured worker might no longer be able to pay a child support order, or might want to start a new business. Our office can assist with those types of issues as well.
Practice Areas
Practice Areas Description
- Workers' CompensationAt Wolf, Baldwin & Associates, P.C., we can help you understand your rights, what the law says and how the workers' compensation claims process works in the Commonwealth of Pennsylvania. More importantly, we can help you secure the benefits you deserve for your work-related injury or illness. We can answer your questions regarding workers' compensation and the protections offered to injured workers under workers' comp law: administrative law and the workers' comp system; starting a claim; denied claims; the hearing and appeal process; modifying, keeping or getting benefits reinstated; and protection after you return to work.
- Denied Claims Appeal
Pennsylvania employers and their workers' compensation insurance providers will try to use almost any excuse to deny your claim. For instance, they may try to claim that you were actually an independent contractor and not an employee. They may try to claim you were not injured at all, or that your injury did not occur at work. At Wolf, Baldwin & Associates, P.C., we know the law and we have litigated almost every type of workers' compensation coverage issue. With more than 70 years of combined experience in southeast Pennsylvania and three lawyers dedicated almost exclusively to helping injured workers, you can be confident in our ability to protect your rights and help you successfully appeal a claim that was initially denied.
- Fatal Claims
Our law firm has more than three decades of experience to draw from in helping you. We know the workers' compensation process and local legal community, and we take pride in working closely with our clients by keeping the lines of communication open throughout the process. Let us put our experience, knowledge and compassion to work for your unique circumstances. We can help both with pursuing fatal claim death benefits under PA workers' compensation, and also with any probate, estate planning, or inheritance tax issues which may arise.
- Employer Retaliation
At the law office of Wolf, Baldwin & Associates, P.C., our worker's compensation lawyers have been helping injured workers for more than three decades. Contact our Reading, Pottstown or West Chester law office to schedule a free initial consultation if you are experiencing any of the following: if you are being pressured to return to work; if the company's medical experts are contradicting your treating doctor; and if you believe the company is trying to force you to quit by failing to make needed accommodation.
- Workplace Injuries
Different types of injuries, illnesses and medical issues can impact your workers' compensation claim and how long your benefits might last. or information on some of the work-related injuries, illnesses and medical issues we regularly deal with in our practice, please see the following pages: carpal tunnel syndrome (and other connective tissue injuries); occupational illnesses (for example, hepatitis in healthcare workers); orthopedic injuries (disc herniation and neck pain or low back pain, bone fractures, knee and shoulder problems, and other musculo-skeletal injuries); specific loss benefits (including burns, disfigurement, amputation injuries and hearing loss); and pre-existing medical conditions.
- Carpal Tunnel Syndrome
Carpal tunnel syndrome and other repetitive motion soft tissue injuries are a risk for anyone whose job requires them to perform the same physical tasks over and over again. In medical terms, carpal tunnel syndrome is a progressive injury that occurs when the median nerve that runs between the forearm and hand becomes pinched or stressed. Over time, this leads to tingling or burning sensations in the hands, decreased strength in the hands and eventually can lead to permanent damage to the affected muscles, ligaments, tendons and nerves.
- Specific Loss Benefits / Amputations / Scarring / Vision and Hearing Loss
In Pennsylvania, workers who sustain a permanent "loss of use" injury may be eligible for substantial financial compensation even if the injury does not cause them to miss any significant amount of time from work and even if the loss of the body part is not complete. Known as "specific loss benefits," these benefits are available for scarring on the face, head and neck, amputation injuries, hearing loss, vision loss and certain types of burn injuries. They are paid to the injured worker over a specific number of weeks of benefits, separate and apart from the worker's ordinary wage loss benefits.
- Toxic Exposure
Exposure to hazardous chemicals is an everyday reality for many Pennsylvania workers, and unfortunately, so is the risk of developing an occupational disease. Approximately 10 percent of patients seen in a medical setting are diagnosed with a work-related illness or job-related exposure to toxic substances. Because toxic exposure at work can take years to develop into an illness, it can be difficult to prove that the illness is it is a work-related illness. Occupational disease claims are aggressively contested by employers and workers' compensation insurance carriers. For this reason, it is important to have an experienced occupational disease lawyer working to protect your rights and interests.
- Orthopedic Injuries
A back, neck, shoulder or knee injury can be extremely painful and disabling. Even a "minor" foot problem can prevent a person from being able to do certain types of work. These and any number of other orthopedic injuries involving the muscles, connective tissues (ligaments, tendons) and human skeletal system are common among today's workers. Unfortunately, it is often not as easy as it should be for people to get the medical care and wage loss benefits they deserve from employers and workers' compensation insurance providers.
- Aggravated Pre-Existing Medical Condition
When a person's job makes a pre-existing medical condition worse, the "aggravation" of that pre-existing medical condition is considered a new injury for purposes of workers' compensation. More often than not, employers and workers' compensation insurance providers will deny you workers' compensation benefits in this situation by claiming that the "new injury" isn't new at all — that it is simply the inevitable worsening of the pre-existing knee injury. At Wolf, Baldwin & Associates, P.C., we are no strangers to the workers' compensation courtrooms of southeastern Pennsylvania, nor to cases where clients have been unfairly denied medical and wage loss benefits because of pre-existing medical conditions.
