In all of our practice areas, we strive to hold wrongdoers accountable and vindicate the rights of employees no matter the industry, position, or income level.

The firm of Zatuchni & Associates was founded by lead attorney David Zatuchni. Zatuchni & Associates represents the interests of employees from Wall Street to Main Street, from Manhattan to Staten Island to Trenton, who have been injured by discrimination, harassment, and illegal employment practices. Labor and employment discrimination lawyer David Zatuchni has a great deal of experience in employment law, beginning his career on the other side of the table, defending corporate employers who had been charged with labor law violations and sued for employment discrimination. Through that experience he recognized what employees need to bring successful lawsuits against large companies; highly aggressive plaintiffs’ counsel that specialize in employment discrimination law and know all in the ins and outs of the anti-discrimination statutes.

At Zatuchni & Associates we provide our clients with personalized service and fastidious attention. We provide regular status reports and are highly responsive. We take a team approach in our work: we need your help to prove your case; you are an integral partner and are never out of the loop. Your goals are our goals. Count on Zatuchni & Associates’ New York City, Newark, or Princeton employment law attorneys to aggressively protect your rights and interests in the workplace and in court.

Practice Areas

Practice Areas Description

- Employment and Labor Law

Our goal at Zatuchni & Associates is to help all levels of employees who have suffered due to unlawful actions in the workplace. We seek and obtain financial recovery and other forms of redress for those who have encountered discrimination, harassment, retaliation, wrongful discharge or firing, and other illegal employment practices. Our employment law attorneys use their in-depth knowledge of state and federal law to assert the employment rights of those harmed by the illegal actions of their employers.

- Racial Discrimination and Harassment

Racial harassment and race discrimination can happen to any level of employee at any type of company. While most people know harassment when they see it, discrimination can be harder to identify. Our race discrimination lawyers have handled cases for white-collar workers and executives suing insurance companies, mortgage companies, fortune 500 firms, and Wall Street companies. We’ve also handled hundreds of cases for blue-collar, administrative, and sales force workers. Racial discrimination knows no boundaries. Our goal is to help you find financial recovery and justice through the legal system.

- Ethnic Discrimination and Harassment

All workers have rights in the U.S. All workers are protected from discrimination, harassment, and illegal treatment. Foreign workers are frequently subjected to discrimination or harassment in the workplace. At the employment law offices of Zatuchni & Associates, our employment discrimination attorneys have seen and taken every type of national origin discrimination case. We also take complaints from groups of foreign employees who are all being treated unfairly in the workplace due their immigration or foreign national status. We have worked with Muslim clients from Egypt, Jordan, Pakistan, and India. We have represented African workers, including many from Kenya and Nigeria. We frequently represent South American immigrant workers from Mexico, El Salvador, Nicaragua, Cost Rica, Cuba, and Puerto Rico.

- Sex Discrimination

Sex discrimination can happen to people of either gender. The sex discrimination lawyers at Zatuchni & Associates represent any worker who has suffered sex discrimination in the workplace. Contact the law office of Zatuchni & Associates to speak to a New York or New Jersey sex discrimination attorney. Our goal is to help you find financial recovery and justice through the legal system. Sex discrimination, or gender discrimination, has many of the same characteristics as race discrimination. It is unequal opportunity and economic discrimination under the New Jersey Law Against Discrimination or Title VII of the Civil Rights Act.

- Sexual Harassment

Sexual harassment on the job comes in two equally damaging forms. The first is a straightforward demand that you sleep with the boss, or implied threats that you provide sexual favors or else you'll be demoted, fired or have your hours cut or changed. Many foreign female workers are subjected to this type of treatment because their supervisors think they can get away with it due to the female employees' immigration status. Some immigrant female employees think that they have no legal recourse. This is Not True. U.S. labor law protects all workers — legal and illegal immigrant workers are protected.

- Age Discrimination

Discrimination on the basis of age is illegal and yet people over age 40 face discrimination in hiring decisions, in promotional opportunities, and in training opportunities. Despite their ability and experience, employees and managers over 40 are often the first to be affected by staff reductions and layoffs. The age discrimination attorneys at Zatuchni & Associates represent employees who have suffered economic losses or a promotional “glass ceiling” due to age discrimination. If you have been laid off and you believe your company unfairly discriminated against you because of your age in its layoff decision, contact our office about filing a lawsuit or an EEOC complaint. Our lawyers handle individual and class action age discrimination lawsuits and unfair terminations. lawsuits.

- Gay and Lesbian (GLBT) Discrimination and Harassment

Both New York and New Jersey law prohibit workplace discrimination on the basis of sexual orientation. Despite these legal protections, GLBT people frequently face discrimination and sexual harassment in the workplace. The sexual orientation discrimination lawyers at Zatuchni & Associates represent the interests of workers who have suffered discriminatory or harassing actions in the workplace because of sexual orientation, gender identity or gender expression. If you have complained to management about a hostile work environment and offensive remarks of coworkers or supervisors and nothing has been done to address your concerns, it’s time to contact an attorney.

- Pregnancy Discrimination

If you are pregnant, protections exist under the law. If you've come back from a pregnancy leave only to find yourself unemployed, you may be eligible for back pay, front pay and damages. Pregnant women are protected by the Pregnancy Discrimination Act and state laws such as the New Jersey Law Against Discrimination. Additionally, pregnant women and people with serious illness are covered by the Family and Medical Leave Act (FMLA). Contact us and talk with a disability discrimination attorney at our firm regarding a discrimination or FMLA claim.

- Wage and Hour Disputes

The Fair Labor Standards Act requires that workers are paid for hours worked. Employees are open to mistreatment when they don’t have a clear understanding of the rules and their employer uses that lack of knowledge to act illegally and unethically. The most common wage and hour problems we see at the employment law firm of Zatuchni & Associates are overtime hour abuse and employees being wrongly classified as exempt or as contractors so the employer can avoid paying overtime or benefits and payroll taxes. If you believe your employer has violated wage and hour laws and you have paid the price — whether that violation was accidental or planned — contact a New Jersey or New York overtime pay lawyer at Zatuchni & Associates to see if you have grounds for a lawsuit.

- Disability Discrimination

In 1990, the Americans with Disabilities Act (ADA) was created to eliminate barriers to employment for people with disabilities. American businesses are still trying to reach that goal, but some are not trying hard enough. The disability discrimination lawyers at Zatuchni & Associates provide legal services to workers who have suffered discrimination, even injury, because an employer refused to make adequate accommodations in the workplace. Contact us to learn more about how we can help. Our lawyers serve clients in New Jersey and New York seeking financial recovery and justice through the legal system.

- Wrongful Termination

Employment in New York and New Jersey is “at will.” What that means is that, unless your employer made a specific promise about the length of your employment in an employment contract, the employer can fire you or lay you off at any time with or without reason. However, there are some reasons for which your employer cannot fire you. If they do, you may have cause to bring a wrongful termination lawsuit. Talk to an experienced New York or New Jersey wrongful termination attorney at Zatuchni & Associates.

- Family and Medical Leave Act

If you meet the eligibility requirements, the law says employers must grant unpaid leave for 12 weeks in a certain time period (12 or 24 months, depending on whether it's state or federal law) in circumstances that include: birth or adoption of a child (beyond maternity leave); care for an immediate family member; and the employee's own serious health condition. The employer is supposed to allow you to return to your job or put you back in the same type of position. In practice, despite labor law protections, employers often terminate employees who exercise FMLA rights and claim the employee would have been terminated anyway, due to a mass layoff, poor performance or some other reason. Our law firm knows how to challenge pretextual firings like this. We will aggressively pursue damages against your employer for all of your economic losses, including lost benefits and pension accounts.

- Whistleblower Law

Federal and state law protects employees who report, complain about, or oppose fraudulent and illegal conduct by their employers. For example, the New Jersey Conscientious Employee Protection Act (CEPA) allows an employee who has been subjected to retaliation for reporting an employer’s fraud or improper conduct to file a lawsuit in the Superior Court and to seek damages for lost pay, emotional distress, and punitive damages. It is VERY important to bring a whistleblower within the right time. The statute of limitation for whistleblower cases is often different for discrimination cases. Let the New York and New Jersey whistleblower law attorneys at Zatuchni & Associates ensure your interests are protected by filing a claim in the right manner.

- Qui Tam Claims

Discovering that your employer defrauded or stole from New Jersey state or federal governments, you need to take immediate action. The False Claims Act allows employees to assert a Qui tam claim. An employee or any citizen can take file a civil lawsuit against a business defrauding the government. The benefits are numerous. Not only is the employee reporting illegal acts, but they can also recover a percentage of the money recovered on behalf of the government. Common Qui tam cases include: Medicare or Medicaid fraud; fraud in federal or state contracts; and false certifications made to the federal government.

- Retaliation Protection

If you were fired, given worse work hours, demoted, or lost income because you complained about ethnic discrimination, religious discrimination, national origin discrimination, harassment, or unequal pay, you may be able to sue your employer. Contact a lawyer at Zatuchni & Associates if you are facing abuse or retaliation. You have rights in your workplace.

- School Harassment

Through legislation and court decisions, New Jersey has sent a strong message to schools that they can be held liable for failing to protect students against harassment or discrimination based on prohibited factors such as perceived sexual orientation or race. At Zatuchni & Associates, we advise and take action on behalf of students who have been harmed by a school district's failure to take action to protect them from harassment or discrimination by other students. Contact us today to learn more about how we can help. With offices in New Jersey and central New Jersey, we serve clients throughout the state in these cases.
