Areas of Law Description

- ERISA

ERISA provides that a long term disability plan administrator shall notify a claimant of the plan's benefit determination on review within a reasonable period of time, but not later than 45 days after receipt of the claimant's request for review by the plan. If the plan administrator determines than an extension of time for processing is required, written notice of the extension shall be furnished to the claimant prior to the termination of the initial 45-day period. In no event shall the total period of review exceed 90 days.

- Back Conditions

Back pain and disorders of the spine are a common type of disability handled by the firm. In many ways back claims are the most challenging in terms of recovering long term disability benefits. Nevertheless, these cases are winnable when presented properly.

- Pain Disorders

Many claimants who suffer with Chronic Fatigue Syndrome (CFS), fibromyalgia, lyme, and migraines, have cognitive difficulties (and not simply depression). Our attorneys use a battery of tests that can be administered in neuropsychological testing to help to identify how or where a claimant is suffering cognitively, and effective utilization of such testing can help us demonstrate our client's impairment.

Although courts recognize that many high profile individuals, including former Vice-President Cheney, President Eisenhower and Associate Justice Stevens, returned to work after suffering a heart attack, the disability benefit experts of develop and successfully argue each case based on its own particular facts and circumstances. Disability claims are common in both the corporate and financial sectors for stress related conditions, including heart attacks.

- Physician Related Disability

A critical issue for the firm in physician disability cases is determining a physician's occupation. We often present evidence that the physician's regular occupation is a specialty or sub-specialty as opposed to a broader occupational category.

- Mental and Nervous Disorder

Most long term disability polices covered by the Employee Retirement Income Security of 1974 (ERISA) limit benefits to one or two years for disabilities caused or contributed to by mental illness. Some policies do not define mental illness at all. Those that define the term do so differently. It is therefore important for the disability benefit experts of our firm to analyze both the language of the limitation itself, and the definition of mental illness, if one is contained in the policy.

- Psychological and Neuropsychological

There are several conditions, beyond the easily identified depression and anxiety impairments, where insurers have become more aggressive in pursuing psychological and neuropsychological testing. These conditions include Fibromyalgia, Chronic Fatigue Syndrome, Lyme Disease, Migraines, and even orthopedic impairments.
